Show Me Your Cards.

We’ve been waiting to find out what the Legislature plans to do about the findings of the Branchflower Report, which came to the conclusion that Governor Sarah Palin abused her power in the dismissal of Walt Monegan from his position as Commissioner of Public Safety.
I like to boil things down to a basic level, because sometimes we become distracted by details, and personalities, and unrelated information. As a child, I used to listen to recordings of the old radio show “The Shadow.” At the beginning, the narrator would inform us that Lamont Cranston aka “The Shadow” had “gone to the Orient and learned the secret of clouding men’s minds.” I loved that. Now, years later, that metaphor reminds me of the Palin administration. They may not have traveled to the Orient, but they definitely have perfected the art of clouding men’s minds. Just look at our legislature.
Here’s a review of the facts as I understand them:
- There was enough reason to suspect that Gov. Palin had abused her power in firing Commissioner Monegan that the Legislature agreed to an investigation.
- The bipartisan Legislative Council chose (D) Senator Hollis French to manage the hiring of an independent investigator.
- The bipartisan Legislative Council agreed that Stephen Branchflower was the best man for the job of investigating the matter in an unbiased and non-political way.
- The bipartisan Legislature voted to spend up to $100,000 to conduct this investigation
- The Legislature issued subpoenas to state employees and others to appear and give testimony.
- Those state employees and others did not honor their subpoenas.
- At the completion of the report, the Legislative Council voted unanimously to release the results to the public.
- The first determination of the Branchflower Report was that Governor Palin had abused her power, and violated the Alaska State Executive Branch Ethics Act.
Those are the facts.
Now, read this article in today’s Anchorage Daily News entitled “Little Troopergate Interest in the Senate.”
Senate President Gary Stevens, R-Kodiak, signaled the feeling in the majority is to move on from it.
“I think what I’m not hearing from this caucus is a consensus of moving ahead with any further investigation…We received a report. We made that report open to the public. So I think in terms of that issue, that’s closed. We’ve taken care of that and in my opinion we now need to move ahead on the bigger issues of the state, working with the governor,” he said.
There’s a trick in learning how to communicate effectively with others, where one person says what’s on their mind, and then the other person says, “So, what I hear you saying is that __”(fill in the blank with what you think they said)”___ This works well because it means that the person speaking is being listened to, and also that they know whether or not the listener has taken away the correct message.
So, (clearing throat) Senator Gary Stevens, what I’m hearing you say is: We commissioned a report. We paid for a report. We got the results of the report which said the Governor abused her power and violated the Ethics Act. We told the public that this was the result of the investigation. And now, without any consequences, the matter is closed. And we need to ‘move on’. Am I right? (knocking on Senator Stevens’ head) Am I right??
He’s not answering me, but his communication sounds pretty straightforward to me.
I am not so naive to think that the Legislature would suddenly awaken from their slumber, have their minds “de-clouded” and realize that these issues are actually important. I did not expect a sudden growth of spines and other body parts which would cause a mass moral outrage against the governor. Because, writing a little piece of paper that says, “By the way governor, we really don’t like it when you promise to cooperate and don’t. And we really don’t like it when you abuse the Ethics Act. It kind of sets a bad example, you know? So, now you know that we know that you did, so don’t do it again” might just be a little too….uncomfortable for the majority of legislators.
But what we should want, and ultimately what we will get is this: We have not allowed Troopergate to fade away into the legislative sunset. People have spoken up, they have organized, they have raised their voices, they have pointed out the bullet list above, and they have made their opinions known. And if, as the Daily News suggests, nothing will come of that, we will have forced our legislators to put their cards on the table. We have forced them to bare their souls, and make statements. The statements have run the gamut from one side to the other. I, and other Alaskans know exactly who thinks the Governor should be held accountable and who doesn’t. We know who thinks it shouldn’t go away, who thinks it’s history, who thinks it’s a Palin “lynching”, who thinks citizens speaking their minds are “coreligionists” acting like “vanguards of the Lord’s army” and who thinks that Branchflower is “exactly on point.” And some of us have long memories and a willingness to apply our political energies.
The dim silver lining on this big black motherless cloud, is the fact that there are those who do seem willing to address the issue of the ignored subpoenas. Rep. Les Gara has commented on this in the past, and it has been mentioned by Rep. Mike Chenault, Senator Kim Elton and now Senator Hollis French. The Legislature has broad powers. What will they do with them? Does Alaska want an Attorney General at the helm who thinks that subpoenas are voluntary? It surprises many that AG Talis Colberg has yet to be thrown under the Palin bus. They may need to clear out that area to make room.
So, Alaskans, keep holding your elected representatives’ feet to the fire until they show you their cards. And once you see them, remember what they are.

I do not understand why, with all the info at hand, there is NO will on the part of the Legislature to make this woman deal with the consequences of her own behavior.

I’m so disappointed in Gary. He ostensibly represents me, though certainly not in this instance, and never again if I have anything to say about it. The last time we spoke, he said that there is no doubt that the Governor abused her power. But his only suggestion for action after the fact is to make sure the AG becomes an elected position. I guess that big Chair is mighty comfy, it has already made him weak.
Remember when Gingrich was found guilty of unethical behavior and he had to pay $300,000 to cover the cost of his investigation? Even that wouldn’t satisfy me, but at least it would be a start.
AND while we’re on it. I hope everyone who voted to change the rules for collecting signatures for voter’s initiatives, understands now how they helped concentrate power into the hands of the greedy few…

I think all you need to do is wait until the new US attorney for the Alaska district is appointed at DOJ and then file a formal complaint against the Alaska AG for obstruction of justice. Be prepared for the scattering of vermin when that rock is turned over. Remember, it’s not the crime but the cover-up. You might want to add to the bullet list the creation of unofficial e-mail accounts for conducting state business outside the scrutiny of public disclosure laws. That probably constitutes another obstruction charge. Toss in the blatent evidence of perjury, either the Palins lied or the ex-commissioner lied, that needs to be investigated as well.
Then there are all the conflict of interest issues, Trans-canada being just the biggest one, all the way down to minor mining lawsuits already discussed a bit elsewhere.
It seems to me as a way-outsider that the Ak. Legislature was just posturing pre-election to garner a little credibility with the electorate. Now they want all that mess to “just go away”, problem solved, so that they can address the big issues facing the state now. Well, if that is how they solve problems, whatever they do now will come back to bite Ak. badly in the not too distant future unless you hold their feet to the fire.

It is frustrating, but I’m afraid that the Legislature’s options are somewhat constrained by the Alaska Ethics Act itself; in particular by its Article 5 (Enforcement; Remedies). It’s probably reasonable to ignore the references to the Personnel Board — the Legislature has plenary investigative power — but the Act does restrict the range of remedies available. Although the Act clearly states that it is a violation if the offender receives “personal” benefit, almost all of the penalty section clearly assumes that there has been some financial benefit to the offender that needs to be unwound.
Excerpts:
Sec. 39.52.410. Violations; penalties for misconduct.
(a) If the personnel board determines that a public employee has violated this chapter, it
(1) shall order the employee to stop engaging in any official action related to the violation;
(2) may order divestiture, establishment of a blind trust, restitution, or forfeiture; and
(3) may recommend that the employee’s agency take disciplinary action, including dismissal.
……
(d) If the personnel board finds a violation of this chapter by a public officer removable from office only by impeachment, it shall file a report with the president of the Senate, with its finding. The report must contain a statement of the facts alleged to constitute the violation.

So, I am not a lawyer, but it seems fairly clear to me that the Legislature’s options regarding punishment for Palin violating the Ethics Law in firing Walt Monegan are one or more of:
Sec. 39.52.410(a)(1) order her to stop engaging in any official action related to the violation;
Sec. 39.52.410(d) Start impeachment proceedings;
Sec. 39.52.430(c) Void the firing;
Sec. 39.52.440 Fine her $5,000.
The first one is moot, the third one is likely pointless (would Monegan want his job back at this point?), and the fourth one is trivial.
So, the only meaningful recourse available under the Act is impeachment. And, while I would be personally delighted to watch, I understand how even Democratic legislators might feel that this could be counterproductive. But then, I also felt that Nancy Pelosi was correct to avoid another impossible-to-convict impeachment scenario.
The only thing I can suggest is advocating that one or both houses consider a sense-of-the-house resolution reaffirming the Branchflower findings and censuring the Monegan firing. This might be political suicide for the sponsor(s), but it would provide a mechanism for really getting the legislators’ cards on the table, if they had to vote on it.
It would take too long to recall her. Progressive Alaskans’ best bet is to find a credible anti-Sarah to run against her for Gov in 2010. Is Monegan political enough? He seems to have all the right honesty and public-service markers. If she decides to go after Lisa instead, just enjoy the primary. It’s impossible for me to believe that AK will elect a second Democratic Senator in 2010. Just don’t let her get re-elected as Gov. Even if she goes into the Senate, she will be neutralized. She will be a near-invisible junior Senator, with limited brainpower and a declining hotness quotient.

Reading dude’s affidavit surprised me. And then he took a camera around making pictures to prove Wooten was lying about his on the job injury…which did not work…showed their obsession. As well as requesting Wooten’s WC file to be delivered to the governor’s office. What about privacy? I just thought it was out of line.
Two articles on HuffPost today…one same as previously mentioned and one about how she’s trying to go Green…and mentioned 2012 in the article, if I am remembering correctly…someone posted a site about the killing of wolves and bears. I had a very hard time looking at the pictures.
You know, sometimes it pays to go back and google what people were thinking back when this was on the front page; before it got swept under the rug (as our esteemed legislature is trying to do now) I found this article enlightening and it brought to mind that Sarah Palin was running as a hero of “transparency”. Hmmm….time seems to heal all wounds and, ummm, all indiscretions as well. Also, just take time and google, “ignoring subpoena” and see what you come up with. Real people get into really hot water by ignoring court subpoenas. But the real rules for the real people apparently don’t apply to those in public office, or those who are either associated with or are related to, or beholden to those in public office. Sad state of affairs, really.

As someone who has been in AK for nearly 40 years, I can tell you that there is NO WAY IN HELL that First D*ckhead and his AIP friends have near enough clout to take down a Murkowski. No way, no how. And I frankly don’t think there’s any dirt to speak of regarding Lisa. All of the muck has already been covered. Appointed by Dad? Oh well, was duly elected the next time. Shady land deal (as w/every other politician)? Yup, dug that one up when she was running, nobody cared.
Over the course of the next year+ the GOP will have to see which way the political winds blow. If Obama is making great strides toward uniting the country and repairing the W damage, they will have to find a gentler, kinder side of the party, find someone like Obama to run against him. My guess is Bobby Jindal. It is sheer lunacy to imagine that the big dogs in the GOP will allow the rabid base to wrest control of the party. The boys will come out in force. They thought it would work this time and it blew up in their faces. I honestly think that McCain would have won if he’d not had Palin on his ticket.
It’s not going to happen for her, no matter how much she rallies the base by playing victim of the MSM & bloggers. If she wants to run she will have to wait until Obama is done (hopefully 8 years), then a reinvented GOP candidate (an intelligent Repub Obama-alike), then when that doesn’t work they will go back to the right-wing-abortion-nutty-base. That’s not 4 years or 8 years, it’s 12 or more. By then she’ll be over 50 and someone younger and hotter will be moving up on her. They cannot bring out the base that she appeals to — which clearly alienates everyone to the left of rabid pro-life — unless Obama enacts some completely egregious abortion legislation.
That’s my opinion as a long-time Alaskan who has nearly always voted Republican (not W for a second term or McCain this time).
I’ll be interested to see what happens with the FBI’s investigation of Clark, Frank Murkowski’s Chief of Staff. He plead guilty to one felony count in exchange for cooperation… The timing will be interesting. AKM

When I told folks down here in ID what the Gov and legis up there aren’t doing about the folks out in the Villages, I keep getting isn’t that just like, genocide?

I just wanted Mudflaters to know what is being said down here in my neck of the woods. I’m wondering if that word got out about town up there is someone would stop paying attention. From what I hear hungry and freezing people have a hard time paying attention, so the Gov and some of the legis can just keep on doing what they’ve always done.
It just may be a new day, now that Obama is paying attention. I been sending him updates daily as I discover them about how little SP and her gang are doing in this emergency.
Sorry if that last post was OT, I just would like to see SP’s list of unethical behavior include her lack of action for her constituients. And I’m still just waiting for the new transparentcy policy Obama just signed to uncover her “housegate” and “community center gate” dealings.

Unless something really weird comes out in the next two years, I don’t expect her to try for the Senate. That’s why I say you all should concentrate on finding a single good opponent to go against her for Gov.

maybe it’s time to start writing Pres. Obama about this situaiton, he’ll get it done and she’s the one that will look like a smacked ass.
I have a few things to say (as per usual):
First, the Alaskan people should start a petition to force the Legislature to either impeach Sarah Palin or recall her. I’m not sure how many signatures it needs but they cannot ignore it. This is what I would do if I were an Alaskan resident. Please note that signatures need to be from registered voters. I will try to remember to look up the percentage of registered voters you would need to make it an official petition.
Second: I am of the opinion that Alaskans are not dim bulbs and that Palin will not be re-elected to the governor’s seat nor to Congress.
Third: Sarah Palin is just damned dumb. Sorry but I needed to say that out loud one more time. Her constant WHINING is not keeping her in the public eye in a good way and she just doesn’t get it. She’s a sorry excuse for governor and an even sorrier human being.

I agree with SMR – I will be surprised if SP even runs for Senate – Murkowski would chew her up and spit her out. The Republicans aren’t going to want anyone to run against Lisa – she’s doing too well. What’s kind of funny is that SP is the chameleon type and would change her affiliation if she thought she could get away with it. But now that would look questionable since she’s on the quest for national office so that’s the ONLY reason it won’t happen.
If she runs for Governor again, it puts a hitch in her plans to run for national office in 2010. Alaska isn’t an easy place to campaign from, and I don’t think we’d be clueless enough here to elect her again since even the conservatives know that she won’t really be paying attention to our state with other things on her mind.
The more time that goes by, the more sure I am that she’s just going to blow it again and again. She thinks she’s pit-bully but she’s just a narcissistic drama queen and her actions will not stand up to scrutiny over time. And we do have time, and there’s her propensity for open mouth, insert foot which makes her look more and more foolish.
She will give us a lot to do over the next two years, but I believe firmly that she is too tainted with controversy to be a realistic candidate for the R party. And that’s only going to get worse, not better. She still can’t give an interview to save her life if the interviewer has any tough questions at all – and that’s not going to cut it in another national campaign. She’s good at being snarky and bitchy, as in debates and her rallies – but one on one with a tough question – she’s hosed. We can thank her serious personality malfunction for that -amen!
The Rs will need a more moderate candidate period.

Reading dude’s affidavit surprised me. And then he took a camera around making pictures to prove Wooten was lying about his on the job injury…which did not work…showed their obsession. As well as requesting Wooten’s WC file to be delivered to the governor’s office. What about privacy? I just thought it was out of line.

Yes he did that, and I believe (somewhere, they admitted to hiring a investigator) course maybe they said that to camouflage the fact they were using state personnel files, without authorization! Also remember the time during duds affidavit, he was being coached by a RNC lawyer, that was during the campaign. If he hadn’t be coached I’m sure he would of put his foot in his mouth. They don’t call it “bind obsession” “blind ambition” for nothing. That is why if investigated they will be caught. I think Branchflower barely touched the surface of what happened here. And today with the leg. saying they will not do, anything, and then her whining about being a victim of the MSM again, the SOS she is trying to play the sympathy card, make herself a victim in case they change their minds. Remember Dyson’s word ” a Witch-hunt”?
Saw an interesting comment earlier about what it really cost to sell the state jet, here are some questions that should be asked that I think would surprise many people. How many upgrades and improvements were made to the jet that increased the initial cost? What money did the state gain/lose by the sale? Have other planes been put in service to replace everything that was sold to buy/sell the jet? I bet if those questions were answered it would show that Palin’s press stunt actually cost the state a lot of money.
Another interesting comparison might be how many new troopers have been hired and trained since Monegan was fired? Is it more or less that previous years or administrations? I’m not slamming the new trooper commish. just pointing out that it is a long involved process that is very difficult to speed up just because some politician says so or uses as an excuse to fire people.

Does anyone in Alaska know the final story on the arson at Palin’s church? I heard that hospital records were stored there. There was another fire January 5th in which a woman and her two dogs burned to death. The woman was a hospice worker associated with the Mat-Su hospital in Wassila.
I know this is starting to sound like the twilight zone – but if I lived in Alaska I would be asking some tough questions. Has anyone ever heard of two dogs just laying there burning to death? The woman might have had a heart attack, dropped a cigarette and started a fire and not known about it. But, two dogs burning right beside her bed sounds very strange to me unless they had too much to drink and were smoking in bed.
Has anyone looked up the word sociopath? You might see someone you know.
House to investigate why its Troopergate subpoenas ignored
House Judiciary Committee Chairman Jay Ramras – a Republican from Fairbanks – wants to know more about Attorney General Talis Colberg’s role in their failure to show. Ramras could hold hearings as early as next week.

How can we get the FBI, Justice Department, Congress (?) whoever, to investigate Palin and perhaps our legislators as well.
It just does not make sense that the legislators would even want to ignore Palin and Colberg.
Something is going on with the legislators as well; their reticence is not normal. IN FACT, IT IS MORE ABNORMAL THAN PALIN’S BEHAVIOR.
