Alaska Attorney General Talis Colberg Resigns.

The big black cloud that has been following Talis Colberg has finally chased him out of the Attorney General’s office.

Which excuse from the “Big Three Excuses” did he choose?

A) Need to spend more time with family.

B) I’m becoming a “distraction”

C) I’m going to pursue other opportunities

Let’s listen….

“I determined that it was in the best interest of the state of Alaska to move on and pursue other opportunities. It was an honor to serve for the past two years,” Colberg said in a statement issued this morning by the governor’s office.

If you guessed C, you were correct.

Colberg has been residing in a firestorm of controversy starting back in September.  That’s when ten witnesses, including seven state employees, who were called forth to testify via legislative subpoenas in the ethics investigation known as “Troopergate” decided not to show up.  These witnesses and the governor herself had been more than willing to cooperate with the investigation until Palin became the VP nominee.  After McCain’s lawyers descended on the Alaska Department of Law, suddenly everyone, mysteriously had a change of heart.   The Alaskan people, not being stupid, understood what had happened and had an enormous rally on the Park Strip, organized by the group Alaskans for Truth, where 1500 signatures were collected, demanding the ouster of the Attorney General.  An additional 500 were collected after the fact and the whole enormous pile was delivered to Palin spokesman Bill McAllister in the Governor’s office.

 According to Colberg, during a recent grilling from the House Judiciary Committee, he explained that he hadn’t told witnesses to ignore the subpoenas….he just told them they had a “choice” about whether to ignore them.

Nobody bought that one, and the witnesses, including the Governor’s husband Todd Palin were found in contempt, but with no punishment.  Rumors were running rampant that the legislature was not finished with Colberg yet. 

“Talis is a highly intelligent, thoughtful and reserved scholar who brought considerable legal knowledge and great personal integrity to the position,” Governor Palin said. “I appreciate his willingness to serve, and as the search for a new attorney general begins, I will look for someone with the same strong moral character as Talis. I wish him well in his future endeavors.”

So it sounds like we can look forward to another Attorney General with “the same strong moral character” as the one who is resigning in disgrace because of his lack of … moral character.  Nice.

Troopergate is not dead, despite what the Palin administration would like to believe.  There are many loose threads yet to be tied up, and many subplots yet to be concluded.  Will the Alaskan people vote to have the Attorney General become an elected position?  Will the Legislature pay closer attention when they confirm the next Attorney General?  Will the Alaskan people pay closer attention to this process?  Do penalties for criminal witness tampering only apply to sitting Attorney Generals?  What happened with the multiple complaints filed with the Alaska Bar Association against Talis Colberg?  Have we heard the last of Trooper Mike Wooten who, last we heard, is working a desk job?  We may need to wait for these answers, but today, we recognize that public pressure has played a large part in forcing the Attorney General of Alaska to step down.  And that’s pretty big.

Those of you who are familiar with the oddly Shakespearean State of Alaska Department of Law 2008 Annual Report post will know that I asked “When will this play be over?”  The anwer for Talis Colberg is today.

In searching for the perfect Shakespearean sendoff, for our embattled AG, whom I will forever picture in my mind’s eye in a velvet tunic, metal pants and a codpiece, Ithought of Hamlet:

“Goodnight, sweet prince.”

Or Romeo & Juliet:

“Farewell!  God knows when we shall meet again.”

Perhaps The Merchant of Venice:

“Adieu! I have too grieved a heart to take a tedious leave.”

But somehow, I ended up with something from Ogden Nash.  My apologies to the Bard.

Maybe she figured she could either get away for the Alfalfa Dinner or CPAC but not both and had to make a hard choice. Exit question: Huckabee to replace her? The message, at least, will be similar. And he’s anti-stimulus!

    Yes, SP gets to appoint another drooling idiot whose nose is wedged … well you know where it will be wedged. I am writing another POM (public opinion message) to the Legislators, as I did my Rep. Beth Kertulla, to state my opinion that AK needs to elect its AG. That’s sad – the election process will add a new level of fervor to the already weird politics in this state – but having two corrupt govs in a row is just too much for me to stomach any more minions appointed for personal gain and protection.

    Colberg’s resignation is a step in the right direction. It’s just a shame the useless gov gets to replace him with whomever she chooses. Alaska, you have to ‘fix’ that!

    In an alternate universe that I frequently like to imagine, where Alaska has a competent govenor, I doubt if Colberg would have been put in a position to make such a fatal recommendation (re subpoenas) in the first place. Am I out in left field or just naive to suggest that had he not sided with the Gov. he probably would have been fired, a la Troopergate style?

    Talis better be prepared for the worst to come. If he thinks his resignation is the culmination and conclusion to the Troopergate issue, he’s got a lot more to learn. In a lot of respects, I do feel for him – but like Sarah, he did not “blink” when she asked him to serve beyond his paygrade as the State’s top Attorney from his very humble operation. He should prepare for a lot of the blame that continues to surface in criticisms of the Palin Administration.

    Onto a more important subject to me: In the embarassingly gushing school-girl interview Greta Van Sustren gave Mr. Todd Palin, who is 1/16th Yup’ik Eskimo of the Bristol Bay region, made an effort to point out his creds in being a Native advocate as the First Dude.

    In reading the Iron Dog coverage it finally occured to me that it is surprising and a little more infuriating that he (and not his wife this time) has been extremely silent on the YK fuel or food crisis.

    We are not his home region, we are North of the Bristol Bay fishing grounds where he reportedly spends his summer – but a lot of the deckhands and fishermen come down from the YK to work.

    I’d just like to point out that all this talk of electing the AG seems like a really bad idea. Remember, it’s not just the Mudflatters who get a vote — it’s all of Alaska, and you have been paying attention to the sort of people Alaskans usually elect, right? Do we really want a Sarah or a Don in that post?

    Consider, also, most voters won’t be able to verify the intelligence or character or legal knowledge of a candidate without themselves having legal knowledge or personal acquaintance with the person. What will they decide on, then? Whoever has the best ads, and who agrees with them on the issues. We’ll just get a raging abortion debate every few years, and the post will go to the lowest common denominator.

    Also, before his time beneath the wheels of the Sarah bus, Talis was known as an intelligent, honest, competent attorney — precisely the sort of person we’d hope to elect. Before Troopergate, many of us were comforted by the thought of Talis being there to keep Sarah from getting too far out of line. Well, something went wrong. Maybe now that he’s extricated himself from the Palin administration, we’ll get to hear how it happened.

    I had read when Sarah first took office as the newest AK Gov, she asked for and received letters of resignation from all of her officials who were serving “at the Governor’s pleasure”. She didn’t actually ACCEPT their resignations, just kept the letters themselves — according to what I read — in order to test her staff’s loyalty, just in case she had to accept a “resignation” in the future.

    Could this be the case with Colberg’s “resignation”? Just wondering …

    And I wish I could remember where I read that article. Perhaps even here on Mudflats?

    I would guess that those were actually letters of resignation from the employees serving at the pleasure of the Governor who had been put in those positions by the previous governor. That is standard practice, and almost all of them are accepted so that the new gov. can put his/her own people in those positions.

    One of the attorney commenters here said a while back that any complaints (or whatever the official term is) filed with the bar against Colberg re: the subpoena issue or anything else are private until they reach a certain point, at which details are then made available to the public.

    Perhaps it’s not outside the realm of possibility that details of bar complaints are about to be made public, and they will be be favorable, hence a decision to resign in advance of that.

    Mmmm, mmmm, things just get more and more interesting up north. And here I foolishly thought that I would go back to not paying attention to politics after the election and the inauguration.

    But there’s all this stuff out of Alaska that is so much better than anything on prime time TV.

    I would think that TC isn’t off the hook at all. He did, after all, play a part in that refusal by the group to show up.

    Oh, and as to electing your AG, we do here in Washington state and I think it’s preferable. Yes, it means you, as the voter, have to read through some things to see if the candidate is qualified. (We get a nice voter’s pamphlet before each election with info about all the issues and the candidates.) But being elected means the AG isn’t hand picked by the governor, and that’s a good thing. I just can’t see how you could trust anyone who is appointed by Sarah Palin.

    There’s no way Palin’s personal attorney will be nominated.

    The concern about Colberg is he acted like a personal attorney to the governor and whored Alaska’s sovereignty to a national political campaign. There is just no way Tom will get nominated. Just ain’t gonna happen. This is why Colberg resigned in the first place. Palin was a bad, bad, bad unethical girl; she desecrated the executive branch ethics act; she told her AG to rape Alaska’s constitution and statutes, and after an exceedingly long cooling down period (since last September) there will finally be consequences. As standard- established- Palin procedure, at least one human body must be thrown under Palin’s bus (Colberg) for Palin to drive over.

    They can go ahead and nominate Tom. Good luck. Ha Ha Ha. Forget it.

    To look good they will nominate someone who has an understanding of Alaska’s constitution. (Tom does too– he’s one of our greatest living attorneys– wouldn’t you want him if you needed him?) but he’s Palin’s attorney so he’s toast for AG at this time.

    I hate Palin. I admire Tom. Tom’s the best. Tom won. Whether you like it or not, he did his job and he was really good. Kind of reminds me of Bond. James Bond.

    Bzzzzzt. Partially correct.

    Alaska has a treaty with the federal govt. on the 1002 ground. It’s a 50/50 split. The feds never honor treaties (ask any Native American about that), so Alaska ends up in a 90/10 split, with the feds taking the 90%.

    Don’t worry, ANWR didn’t get opened when “all of the stars [were] in alignment,” so it’s not going to get opened now, no matter who wishes it and how hard they wish.

    BTW, Alaskans are American citizens.

    I’m in total agreement with Pat! Yes, here in Blue WA State where much of the more densely populated Western side leans Dem, our Attorney Genl is a Republican that’s done fairly well for us. Being elected, he KNOWS that he’s working FOR the people of the state, not simply being one of the Gov’s lackeys.

    I hope AK legislature wastes no time in setting up & changing the laws to get the AG position as an Elected Position – before Palin has a chance to appoint another one permanently (& muddying up the waters).
