Berta Gardner was on KUDO with CC today talking about the mysterious letter of vaguely phrased acceptance passing through hands at the capitol building, and a meeting with some but not all legislators. Alaska lawmakers have no intentionof agreeing to Gov. Sarah Palin’s demand for all senators to vote in public on her appointment of Tim Grussendorf to the state Senate. That’s set up a showdown with no clear resolution, and talk of a potential court battle between the Legislature and the governor.

Mudflats Still Hearts Les Gara
Rep. Gara got a little bit of flack from Mudflatters the other day, so I wanted to make sure you all saw what Own the Sidewalk had to say:
Rep. Les Gara is a member of the Joint Select Committee on Legislative Ethics.
So even if he thinks something should be done about Rep. Doogan’s behavior, he can’t publicly call for such a something to be done, because he is one of the legislators who will be evaluating said something. Ethics complaints aren’t supposed to be filed by legislators, my darlings; they’re really supposed to be filed by members of the public. If you really want Rep. Doogan brought up on an ethics complaint and you actually want it to stick, the last thing in the world you want is for Les Gara to be issuing press releases demanding it.
(Side Note: Furthermore, sources out of Juneau are telling me there’s been a bit of a scuffle in the Democratic caucus, and not just because of the whole Grussendorf thing. Apparently another Democratic legislator called Rep. Doogan out on the Mudflats situation and things got a little tense. The name of that other Democratic legislator? I’ll give you one guess.)

I just wanted to say, the new article up on the ADN that justified Doogan’s outing of your, was very, very wrong.
As I read it, and I hate to say this, that maybe, just maybe, the author had a valid point.
But no, the author was simply regurgitating the ‘bloggers are the extremist, ‘astro-turphing’ argument. This simply demonstrates that the author of this BS article simply does not get it. He claims that you, AKM, are out there to rally your hordes of faithful readers to ‘pump up’ your causes.
Let me tell you, as a faithful reader from the beginning , that you have done NOTHING to validate what this author is saying. You are simply elaborating events from your point of view, and it is your readers’ choice as to whether or not they want to take further action.
Sorry if my post is a little ‘ranty’. I am just so incenced at these traditional media blowhard attacking you from every angle. It is unfair, very unfair.
I will say this. They can say what they want about you in their printed pages, but ONLY if they let you have a say there too. I don’t care what it is, a compass piece every week, or some other outlet to let you defend yourself on THEIR pages. But for them to attack you on the ground that you simply want to remain anonymous, is from my perspective sheer jealousy.

I am so glad to be a Mudpup. We have gone viral and are recognized as an authentic blog that addresses the bad and good of the politicians in newspaperasand publication. AKM who is one of the best writers that we have ever witnessed, who not only writes truth with evidence but does it with some of the most creative flair and humor that I have ever seen, has inspired people globally. That is a major accomplishment. I have been around on this post which is an incredible blog for a very long time and I have been so enlighten. And now some of the people who hold public office are begrudgingly giving AKM her props. OK, but we recognized her political brillance a long time ago. I say all this to say that I am a warrior for any group who wants to try to bring AKM efforts down because we will not be deterred.

I think there is a big FEAR about who Doogan’s “Anonymous Source” that outed AKM might turn out to be. IF that person providing Doogan with info turns out to be somebody from one of the newspapers, it could create problems, given how many newspapers are folding these days. If a newspaper doesn’t believe in ‘confidentiality’ or protecting their sources, same paper could potentially lose a LOT of subscriptions. Just my thought.

Thought of you yesterday while I was writing a history entry for a book, I wrote:
“The Alien and Sedition Act of 1798 included 4 laws: the Naturalization Act, requiring aliens to resident in the country for 15 years, rather than the former 5 year requirement, before gaining U.S citizenship; the Alien Act, giving the president the power to deport aliens found to be dangerous to the peace and security of the United States (during peace time); the Alien Enemies Act, allowing for the war time arrest, imprisonment and deportation of any non citizen and the Sedition Act, making treasonable acts punishable, including publishing “false, scandalous or malicious writing.”
Twenty five Republican editors, including Benjamin Franklin Bache, grandson to Benjamin Franklin, were promptly arrested and their newspapers shut down.
Immediate opposition questioning the constitutionality of the laws was heard. Jefferson, fearing the government was heading toward dictatorship, secretly authored the Kentucky Resolution and joined by Madison, presented the resolution to the states.
The resolutions presented argued that the government had no rights that were not specifically delegated by the constitution, making the Alien and Sedition Act void. While the resolutions were seen by some as a military threat, Virginia was the first accept the argument within, that states could not be forced to put the laws into effect. The New England states followed in Virginias footsteps.
While the Federalists hoped the Act would quiet the Republicans, especially Jefferson, it instead had a polarizing effect and opened the door to Jefferson’s winning the 1800 presidential election.”
Made me think of Doogan, trying to create his own Sedition Act for anonomoose bloggers, and then finding it did nothing but bring on the heat and send him into a political downward spiral (this one one of the events that ended the Federalist Paty).
Appears some still think “false, scandalous or malicious writing” should be illegal, even if it’s true.

Paula – On NPR yesterday they had a heartbreaking story out of Glenwood Springs , Co. about a young man who came to the U.S. to escape the gangs in Guatemala.He makes good grades in school , participates in community activities , and has dreams of going to Nursing school. The reporter had live statements from teachers , community activists , friends – all stating that he would be severely missed as an important part of the community if he was deported. His Lawyer is doing everything by the book and yet I.C.E. still wants him to go. The community is holding fundraisers to raise money to keep him here. It was quite touching to listen to the people who want him to remain in their community.
Poor Sarah. Now she’s going to have to spend her weekend working with Meg on press releases in anticipation of next week’s news. LOL

To Blooper – I agree with the sentiment behind your post. Extreme annoyance at the hippocracy (sp?) of others does lead even the best among us to “rantiness”
When considering some people’s attempts to justify this action, please remember that 1st Amendment rights are Content Neutral. In effect, your right to say what you want does not depend on what you are saying.
Whether AKM is writing factual pieces, expressing her well reasoned opinion, or encouraging her readers to action – all these are protected speech under the First Amendment. Nothing in the First Amendment requires a person to publicly identify herself in order to exercise these rights.
There are only 2 limits to the 1st Amendment protection:
1. Libel and slander – where the victim would have to prove falsity and damage AFTER the fact
2. Yelling fire in a crowded theater or revealing the movements of troops in the time of war. (US Supreme Court standard of imminent danger that allows prior restraint in VERY Limited cases)
Doogan, as a former working journalist, knows this very well. It was part of his job to know this. For him to try to claim otherwise is utter hogwash.

Calling WAR Attorney General is appropriate, at least in Alaska history. They get the title when appointed and retain it until dismissed.
Funny part is, I wonder if this AG opinion he cites was written by one of the Assistant AG’s he wanted fired. WAR was considered for AG in the third Hickel administration — one of his stances was that all Assistant AG’s should be fired and only those in agreement and of the party of the Governor should be state attorneys.

Can I be the first to go on record as saying there will be no 2010 or 2012 for SP? I expect we will soon hear an announcement along the lines of “Guv SP announces that she will be removing herself from political office to concentrate on her family…something along the biblical lines of “put your house in order first” (sorry don’t know the exact scripture).
She gets all the kudos for putting her family and God first while in reality hoping to let the dust die down so she can reappear in 2016 with a clean slate.

So lets just pretend for a moment that I was one of Doogans constituents who received a nasty email from him. Or his newsletter outing AKM. Or felt he abused his use of the Dem website. I would file an ethics complaint for any/all of the above as a member of the public.
I sure hope some of you guys are doing this. Go get him guys! It’s not all on AKM – you got some power here.

palin, queen of vindictive, is ALWAYS pretending to be something she is not. She is NOT maternal or wise under any circumstance as a governor or any other way…she’s been able to hide and cover up all her dastardly deeds up there in Alaska, where she’s been allowed to do so…and now she doesn’t get it, that the rest of the U.S. is watching and participating…hopefully in her demise as anybody’s leader! SO HELP ME GOD! That was an actual outcry.

It’s extremely scary. And if they’re pinning hopes on SP and she fails (or falls on her face), there are 49 other states for those people to “play” in (or with). Try googling some of the catch phrases, that’s turn your hair white in a heartbeat.

From Les Gara’s newsletter: We just passed an unconstitutional abortion bill. Last time we passed this bill it cost Alaska $1.5 million in legal fees. This time it will cost $1.5 million more. And the bill will be held unconstitutional because, well, Supreme Courts don’t overrule precedent they established just two years ago.
For $1.5 million we could provide college scholarships, and job training, to every youth coming out of foster care in the state. We could insure an additional 2,000 Alaska children. We could hire 15 police officers to put in our high crime neighborhoods, or in villages that have no public safety officers. You get the point.
The bill involved the abortion wedge issue of the 1990’s. Should the government require minors in 1) good, loving, stable families, and 2) in families where parents abuse their children, and families that are otherwise wrecked, dysfunctional, violent or abusive, to get consent from their parent before having an abortion?
I believe parents and minors should talk about things like this. In good families this bill would likely work. But government isn’t too good at writing one-size-fits-all laws telling families how to act. The law that passed requires a minor who is, for example, a foster child, to get the consent of a parent who was so irresponsible they don’t have custody of the child anymore. Why does that make sense? It requires consent from a parent who has sexually molested the young girl, ignored her, or beat her. In my mind, Papa Pilgrim doesn’t get the right to tell his daughter whether she can exercise her right to choose.
The bill contains exceptions – that don’t work. It lets minors who have been the victim of abuse to file an affidavit seeking an exception – but only if they can find a second witness to the abuse who’ll also file an affidavit. Or it lets a minor go to court and prove to a judge who doesn’t know her that she should have the right to choose. Guess what. If you live in a small town, and go to court to get permission for an abortion, and you have an abusive parent, that parent will find out. And, there was no way amendments to fix this language were going to pass. The proponents of this bill, and the opponents, just see the world too differently. One side sees a world of loving parents, and writes laws that don’t work for minors who live in dysfunctional families. The other thinks a law that works in some families shouldn’t pass if it will have to apply in families where it doesn’t work.
As Rep. Lindsey Holmes and I said in committee and on the House Floor, we wrote a bill that works for some families, and that can’t be written to deal with the families where it won’t work.
That’s why, in 2007, the Supreme Court said that the bill’s exceptions don’t work. Nice idea. Bad bill language. And life realities that you just can’t write into a law. While the bill contains some new provision from the one the Court struck down in 2007, it contains the same parental consent requirement that the Court said was unconstitutional. I didn’t have a lot of fun fighting this one, arguing over this divisive issue, and passing a bill I know will be struck down again.

I would like to state that what I find at Mudflats is quality!
The AKM posts are always a great read and easy to verify facts. Even when reading very disturbing news AKM has a way of making it just a little easier to digest.
But I also find the comments to be entertaining as well they also add more valuable info, or just a good chuckle.
But one of the things I like best is that I am very dyslexic and struggle to comment legibly, (spell check does not help much). I tend to find at other sites that people don’t care about the substance I have to say they just criticize my grammar and spelling. This does not happen here at mudflats, I always feel welcome.
But the best is finding kindred spirits who feel as I do about our public servants absurd behavior or the occasional thumbs up when one of them gets something right.
Then we have the Icing on the cake of the delights of Brian and Brenda and other topics AKM touches on.

Looks like she kept her maiden name because her husband’s last name is McLean. I’m guessing she and TP have the same father but different mothers so their last name is the same..since people keep referring to her as his “half sister”. Who in their right mind would willingly KEEP the Palin name after everything that has happened since last September?
I know that I’d be scrambling to the court house’s name change department: “Doe, Smith, Jones…ANYthing but PALIN, pleeeaaaaasssseee?”
If you go to the AK court website she has **multiple entries** for auto-related charges.. repeatedly for speeding, no registration, no license (hmmm, didn’t the current info say she DROVE to the house that she allegedly tried burglarize? “). Also ties into her husband publically saying that when the cops first called him, his first thought was an auto related arrest BECAUSE of her auto history.

crystalwolf aka caligrl……Thank you for posting that letter. It was very informative about why it was struck down the first time. I do not live in Alaska but I truly like Rep. Gara. I like people that stand up for what they believe and willing to put themselves out their as maybe a minority. I sent so many e-mails last weekend way over 200 and he was the only one that replied personally to my complaint and I posted it on the forum. Even if you don’t agree with him sometimes at least you can count on him to standby you when his opinion is the same. World would be pretty boring with just yes men without them challenging you to think for yourself.
I also agree with Rep. Gara it is very bad bill and it can do a lot of harm. In the news are way to many tragic stories involving immature young women making callous decisions in ref. to giving birth. Recently the one with the 9 year old child that had an abortion that was pregnant with twins. The step father was the father of those twins. Who in the world did this child have in her corner. If someone thinks that a piece of chit as the father would give permission to that child is seriously delusional. Won’t even mention about the Catholic church.
I hate that bill will see the light of day and I hate for the citizens of Alaska that are going to pay the price because of hidden aggenda’s of these lawmakers. But I fear that Rep. Gara is spot on in his news letter. Supreme court has already ruled on this matter and this will be money throwed away. I also think it will be more expensive than the first time. The Supreme Court does not like to have their time wasted.

Great post this morning AKM, you still rock. So much to think about as I begin planning my spring garden. I hope the ethics committee gets a lot of complaints. It is a good thing to know the law and to follow proper procedures. When the public gets outraged and riled up over a perceived threat to our rights and safety it is very helpful to us when leaders step forward who can direct our energy effectively.
We want to to be victoriously angry, we want to win our battles to protect ourselves against abuse. This “rights of citizens for protection against abuse by their elected representatives” battle is too important to lose. Les Gara is clearly trying to fight the good fight, I support him. I care about good government in Alaska because it effects all of us. I care about good government in other states for the same reason. We should have no illusion that a mess in Louisana or Texas or California or Minnisota has no relavance to us in Massachusetts or Arizona or North Dakota. No state is an island, not even Alaska.
Thanks for all you do, AKM and Alaskan truth tellers.

After reading Celtic Diva’s comments, I went looking for more info on just exactly which certifications Palin has submitted. Wouldn’t ya know it, those smart people in that new administration in Washington DC have a pretty cool website tracking the stim funds – recovery.gov. This really bothers me too. Has anyone checked into state law regarding AG appointment and confirmation? Does the legislature have any actual clout? or is this something again that needs a complaint filed from the public because Alaska law is so gosh darn wishy-washy?
IMO, any opinion Ross delivers right now, and anything he does prior to confirmation should NOT be recognized. He is not legally AG!

Just baffles me how these people cannot see the problem with GINO. Whatever, she’s a somewhat goodlooking mid 40 something. I am too (well, not hideous and people always think I’m younger than I am, blah, blah, blah.) I always get more of a kick from being complimented on my wit, or intelligence rather than looking OK for my age.

MegA Mouth Stapleton is the official spokesperson for the Palin family, AND the SarahPAC. She is no longer state staff for the Governor – I’m sure the ethics restrictions were just too much for her and the poor thing might actually explode if she had to follow them all.
I doubt she has anything to do with the finances for SarahPAC, officially at least.

The protestors, made up of mostly women, included Ms. Billie Dailey, 82, and several pacifist Quakers. The temperature in Soldotna in March is often just below freezing but it got even colder for the protestors one evening late in the month. While standing on the corner, the protestors were doused with a bucket of cold water from the back of a passing pickup. Jeff Webster, a resident of Soldotna and the father of a Marine serving in Iraq, later admitted to throwing the water. The protestors declined to press charges, saying they understood the stress Webster was under because of his son. The police issued a warning to Webster not to do it again.
Webster did not heed the advice, however, and returned a week later to douse the protestors with even more water. In addition, Webster arranged to have the second dousing videotaped and later distributed the (video set to patriotic music) via e-mail. This time, Webster was arrested and convicted of two counts of harassment and one count of punishing the protestors for exercising their First Amendment rights. He was sentenced to 320 hours of community service, a suspended 120-day jail term, and placed on probation for three years. here’s a comment on this video, made 4 months ago…..not real good logic, he admits the protesters have the right to speak, but this guy says WAR’s client also has the right to throw cold water on people in freezing temps, and this commentor thinks it was funny.
Ahhhhhh NO! it’s not okay or funny. So, I think it’s a valid question, why would WAR free of charge defend this case? And more importantly is he capable of fairly representing ALL Alaskans? hmmmm……this stuff makes a difference. It’s a reflection of who he is.

I was away from the computer for a day or two and was catching up yesterday (it felt like a year!) Some thoughts: Gino and her ilk are very dangerous, and, although I would enjoy dancing in the shadenfreude of her personal and political difficulties, I feel that it is important that she fail as a political person in Alaska and as one with national aspirations.
Her brand of rhetoric is inflamming. Death threats increased against the Obamas after she held rallies and gave her canned speeches: after she was allowed to speak publically. This radical Christian dogma attached to her and other Republicans is damaging to the political discourse of the country, and certainly to the Republican Party, from whom Newt Gingrich says he may split; but how he and others gardened and fed the side that he now says he no longer wants. What she alleged and most of which she spoke was baseless and false, and she loved the hateful spirit which she created.
Alaskans need more and better governance. And our Country deserves better political actors. This democracy experiment is an ongoing one, but we truly deserve better players. I, for one, and so grateful that Bush is gone, but his legacy needs to be extinguished as best as it can. We now have one of the most amazing Presidents that I can remember (I just turned 61.) I truly believe that this deep divisiveness must end, or we will be rendered apart in very ugly ways. The culture wars need to be over, now.
There was just a killing in PA by a man who lost his job and thought that Obama would take away guns. There was already a killing in Tenn. (I think) in Unitarian Univeralist Church, in which the killer stated that he wanted to kill liberals. The FBI has reported an increase of the number of militia-style organizations which they are covering. The ecomony is upsetting enough for most of us. We need to get though this difficulty intact and as a whole, yet once again. She or Newt or Rush or John were not going to get us there, and they never would and never could.
I really needed to say this. Thank you for hearing me out, however you might feel about what I said.

Seems to me that WAR is getting his horse before his cart as is the Gino, once again. WAR might be an “acting” AG until he is confirmed, and he might be giving advise to Gino or she might be saying he is giving advise, but he for sure can’t be making the rules up for his confirmation, before he is confirmed. If he acts like a duck, but the other ducks don’t know he’s a duck and haven’t officially declared him a duck, he’s just pretending to be a duck, it in no way makes him a duck, just a duck head. There will be considerable negative opinions about this with some real time laws being broken if he and the Gino don’t follow existing process. Keep his duck tail nailed to the legal process or you lose simply because he says you do. He knows better, or maybe he doesn’t as he admitted on the radio clip linked back @130, that he has a lot to learn about being an AG. And then again if he doesn’t know what an AG does, why does he think he can do the job?

To ontheKog: What is your point? If North Korea launched a missile-guided satellite into space; could it also not be considered a “test” for its “long-range missile capabilities” to start a war. To date, I don’t think Korea has been successful in launching a satellite into outer space; they have however launched over Japan’s air space (and others). I do not know how long it takes for a nation to determine if the object being shot in their direction is a “missile-guided satellite” or an armed missile with deadly intent.
