Sarah Palin’s Legal Defense Fund is Here!
If you were up all night pacing the floors, wondering if Thomas Van Flein was ever going to get paid his half million dollars (and counting) for what has to be a full time job – defending the governor from herself – you will sleep well tonight. Put your little head right down on the pillow and know that Sarah Palin now has a fund set up, where you and other concerned citizens can pay her attorney directly for stuff like Troopergate, misuse of official position by charging the state for her children’s travel expenses, doing campaign work from the governor’s office, using private Yahoo! email accounts to do official state business, charging the state per diem to live in her house, advertising a brand name sporting goods company who was paying her husband, claiming that emails sent to her husband are protected under “executive privilege,” and violating Alaska law by refusing (even retroactively) to issue a Juneteenth proclamation. One can imagine Palin’t attorney sitting behind his desk with nothing visible but his eyes peering over the top of large stacks of papers. They look a little squinched on the sides….like they’re smiling.
According to the organizer,the defense money raised will go directly to Thomas Van Flein, Governor Palin’s private attorney. Governor Palin owes over 500 thousand dollars in legal bills as she fights a series of ethics complaints filed by Democratic Operatives working in Alaska . The bills are expected to go much higher.
Clayton Paslay, a businessman who splits his time between Texas and Southern California, set up the fund.
Clayton tells me that he has never met the Governor, but set up the fund because he wants her “to get a fair shake.” He also told me that he hopes Sarah Palin runs for President in 2012 because “We need someone to clean up Washington . Someone with grit like Governor Palin.”
Mr. Paslay says he filed all the federal election legal papers for the special fund and spoke with Governor Palin’s attorney. I called Mr. Van Flein’s office and they confirmed that the fund is legitimate.
Paslay expects enemies of Sarah Palin to come after him. Paslay said, “I told Sarah Palin’s attorney that I may need him too.”
And that pile of money just got a little bigger….
The post then goes on to say that even though this fund is legal, it’s not the real “official” fund, which is coming. It will be up and running really soon, but it might require calling every single donor and asking them a series of questions, which they may not want to do, but they’re not sure, but they do know that totally for sure this is really really legal. But in the mean time you can still give your money to the unofficial and also totally really legal one, which is set up now.
And then, just in case you weren’t sure, the post has an update telling us that they’ve double-checked that it’s legal. And not only that but they are going to keep really meticulous and careful records….of the one that’s up and running now. Even though it’s not the official one, they’re going to be really careful. And legal. And legitimate.
Again, just to be clear. Sarah Palin’s attorney has given his assurance that this fund is legal and legitimate. So, if you give to this fund or the “official” one still to be set up, the money is all going to the same place – to pay for Sarah Palin’s legal bills.
So, crack those piggy banks, kids!
And I’m about to give the governor the best legal advice she’s ever had (and I’m not even a lawyer).

I wonder what they will do when the next series of lawsuits arrives (as is inevitable). Dunno if they are a bottomless pit, but O’Reily and Glenn Beck are chipping in (and they are loaded with cash).
In the long run, money cannot really help her – cannot buy ethics or a good reputation. Cannot buy credibility. Cannot pay the world to stop laughing at the GINO finito.
Clayton should take a chance at being a stand up comedian – too funny.

Today, I was in the doctor’s office. They had a March 30th issue of People magazine.
Flipping thru it, I saw six (6) pages devoted to GINO and her family. The pictures were lovely and it looked like great PR. I think she is gaining ground in the lower 48. That’s why she’s thumbing her nose to the people in Alaska.
Gosh, I hope I’m not right! Every day I think she’s going to implode but she keeps on trucking. We don’t want her down here! Help!

Multi-able sources of income. This fund will help build her nation wide PR campaign for 2012. SHe is going to get very proactive creating professional high dollar media clips, trying to prove that she is squeaky clean and honest with all her political affairs.
She is very good at playing the “Poor Me”, energy slurpper roll with her aging wealthy conservative supporters. Especially men that want to help rescue a good looking political damsel in distress. This is a new “victim roll”, pioneered by the great reformer.

I am sooo discouraged. This is exactly where I was emotionally when we moved away in early 2004, Anchorage voters had voted down all of the school bonds and voted to throw away money on some stupid natural gas pipeline “study” (you all know how well that’s gone), and my disgust with Alaska, voters, the politics of Anchorage & our gov were off the charts.
This is a city of 250,000+ people, and less than 40,000 voting??????? What? School bonds being voted down? And cap our little puny (relative to other states/cities) property taxes yes!?!

Maybe Palin thinks it’s a coup to have her own legal defense fund but most people will consider it strong evidence of a pattern of unethical behavior, especially since several of the ethical complaints’ rulings have not been in her favor.
It’s interesting that many politicians don’t require a “legal defense fund” in the first place……

GINO is going to have a hard time cleaning up all her criminal actions in Alaska so what makes him think this deranged, inarticulate, lying, fraudualant, incompetent, lacking of civil knowledge and basic knowledge, breaking of all rules will ever be able to be voted into the office as Presifent of these United States. Excellent advice, AKM. Since it can be delivered in three seconds, a $300 per hour lawyer could give it for a quarter. But for it to be effective, she has to know what “stuff” is illegal. Since this is someone who thinks the First Amendment is violated when a citizen criticizes a public official, the next piece of advice has to be: have a competent lawyer at your elbow whenever you are engaged in anything that might be considered official business. Since she doesn’t do a very good job of separating her personal and official lives, this might require stationing a lawyer in her bedroom, unless there is no telephone within reach.
But I suspect all this is beside the point. As she sees it, she does what she wants to do, and her attorney’s job is to minimize the negative consequences that the legal system might otherwise impose on her.
What’s in it for this Paslay guy? Let’s see he is from Texas, there has to be some behind the scenes deal making……although, I’m sure it’s perfectly legal. No one can make logical decisions with this much personal & political chaos going on around them…not even the Queen.
AKM, ya best be declaring yourself a citizen’s legal advocate before you get outed for practicing law without a licence. Giving legal advice to the Gino to stop doing illegal things is kind of like pouring sand down a rat hole or like the picture above depicts, the Repubs dumping money into the volcano hoping it will not blow it’s top.
With WAR about to rewrite the AK laws to suit the Gino and Van Flein to cover her a$$ for those little $50K infractions that fall through the cracks, she will be moving to the beltway with a get out of jail card free.
So let the Repubs foot those illegal bills with money from their hidden off shore banks. At least some of the $$ will be trickling down to Van Flein’s office staff, who will be very busy typing and filing legal briefs. That’s got to keep many legal begals employed for the next 20 months.

I’m a lawyer (IL, not practicing) and although I am not a constitutional law expert, I can say that this resolution is garbage. The federal government is not the “agent” of the state governments, and it is for the US Supreme Court, not state legislatures, to decide whether federal legislation violates the Tenth Amendment. The Tenth Amendment is not violated by conditions imposed upon states for receipt of federal funding, and no state legislature can “prohibit” or “repeal” federal legislation.
The limited sovereignty of the states is subject to the sovereignty of the United States under the Constitution, and the states do not have the option of making their own decisions as to what the Constitution requires. The Civil War settled that, even though the governors of the “sovereign states” of Alabama and Mississippi had to be reminded of that during the 1960′s. So that they could claim they were acting under duress and not merely obeying the law of the land, these rabble-rousing blowhards compelled President Kennedy to send in federal marshals and (if I recall correctly) federalize the Alabama National Guard in order to protect black men enrolling in their state universities. We’ve come a long way since then — I hope.
This resolution has no legal effect. It is nothing more than a grandstanding announcement that they don’t like the way the federal government is doing things. It does nothing but waste time and impress the ignorant.
We should send in hundreds of checks for .01, just to assure they have a real fun time with the books. And what the heck, it’s tax deducatable, right? Since it’s basically pretty legal, seeming at least, then we can legally assume it’s legal to legally deduct our legal donations, being they’re pretty sure it’s a legal fund.

But, since we’ve all been through that — and I’m sure our Alaska legislators have too — then why, oh why, must we revisit it again …….. when there are so many more important issues to deliberate? How can my state’s elected representatives choose to spend their time on this cr@p? Surely they knew it was grandstanding.
I would think if they wanted to get re-elected, they might want to spend their time on bills that would make some real difference to the people who elected them.

I really don’t know what has happened to the world I live in. It used to be if a lawyer was required for you, you paid the lawyer with your own money. Particularly if they were needed on ethics matters, you were on your own. It used to be a big deal to have high morals and be of good character. Your word was your bond and a handshake sealed the deal. What has happened to personal integrity? I find it frightening that people will give hard-earned money to pay this woman’s legal bills. Just blindly follow her. There is something very wrong here.

Here are some of the comments I picked up. Do not claim they are verbatim but are close.

I certainly think there are more serious complaints than this one. A couple points, though.
This is the only one mentioned on the fund’s website, so it seemed strange not to mention it, especially since I linked to the site. It is technically an Alaskan law. It can be argued it shouldn’t be, but it is. And the thing that surprised me the most from all of that is that no statement was issued, even retroactively. I like it when people make amends, even if the law was violated by mistake, or if the person doesn’t think it’s a valid law.
It reminds me of the illegally posted campaign signs. Even if your sign company are the ones who violated the law, you should still apologize and try to fix it. In the case of Juneteenth, a quick apology, a statement that the holiday and the African American community is supported by the governor, and a retroactive statement would have made it go away, and actually could have been a positive image builder for Palin while making the filer look less legitimate. Just my humble opinion.
The stubbornness in refusing to correct it bothered me more than the original oversight on that particular complaint.

Okay, so I didn’t read the article yet, but I just have to say that picture cracks me up. AKM you’ve out done yourself.
I’m loving it that over at C4P they’re still saying to “hold out for the real Legal Defense Fund”, more or less. There is still a question of legality at least in their minds, last I read. That will deter people from donating.
But really, the last thing I would donate to would be a legal defense fund except in a case I was personally close to and where I KNEW the person needing the funds was innocent. Sarah Palin cannot possibly be innocent of everything she’s been accused of, the old smoke = fire that someone wrote earlier.
But hey, the more they donate to the Fund, the less they have to donate to “CAPharaS” and her as-of-now fictional Presidential run in 2012. And in hard economic times, it’s even more telling what one’s priorities are, as everytime you spend, you vote for what’s important to you.

BTW, is it normal when a fund is set up for legal fees that monies go directly to said lawyer? Me thinks this is called income…and how does the lawyer separate the states business from personal business for his client?
Lemme know when Levi Johnston, has set up a legal fund, to hire an attorney for shared custody and/or visitation rights of baby Tripp.

You ask “How can my state’s elected representatives choose to spend their time on this cr@p?” I don’t know Alaska politics, but a guess would be because a few legislators thought they’d get some mileage out of it and their colleagues didn’t want to get into a fight over something they knew would have no practical effect. I seem to recall that the US Congress spent a good deal of time holding hearings concerning illegal drug use by professional athletes, which, as you know, was an urgent national issue affecting all Americans and really forced them to make hard choices.
The problem with elected representatives spending time on bills “that would make some real difference to the people who elected them” is that they might also make a real difference to the people who paid to get them elected.
Seriously, though, as an outsider I’m impressed with what AKM and others are doing via the internet, enabling people to find out what’s going on and talk about it. It’s a new world, and good for democracy.

Depends: The US Constitution states that all power not claimed by it fall to the states. What we call State’s Rights.
Congress, the SOCTUS, Fed regulations, etc. have greatly restricted State’s Rights, but the wording of the US Constitution remains the same.
At guess all of the original 13 states have similar wording in their Constitutions and probably most or all of the rest do as well.
One of the biggest infringements came with the SCOTUS ruling that Fed laws and regs always trump the state’s.
That’s why the RepoTaliban wants to Federally illegalize gay marriage and abortion. Such a law would trump any state law.
That’s how the Bushies forced California to implement EPA laws with higher pollution emissions than California law and California couldn’t really enforce their higher level of control. Their laws were no longer enforcable.
On the upside the Fed can force universal public education, can force social security, Medicaid, Medicare, the military draft when it existed, etc.
Most states would probably not live up to OSHA and JACHO standards, and even the weakened enviornmental protections mandated by the Fed., etc.

How about legal fund for baby. There’s two babies in that family that need a Salomon.
Sarah may think this defense fund is a good idea now, but doesn’t that mean that all of this information must be disclosed and open to the public?
If she paid her legal fees herself, I would think the amount she spent would be a private matter.
But, setting up a donation fund, it seems like this would be required to be public knowledge. This may bring more attention to her legal woes that she really wants when the public learns how much money is required to continually defend this woman. Just a thought.

Palin’s Defense Fund — I find it strange that the lawyer who deems it Legal of course is the same lawyer that is having his bills paid!! He of course would say it legal firstly because his client is Palin and secondly, it’s paying his bill. Needs further verification and disclosure by uninterested parties.
It also brings to light, that this should be:
a) considered ‘a gift’ and declared by Palin on tax submissions. Just because it is by-passing her hand does not exclude the fact it is for her personal benefit; and/or
b) contravenes the laws or rules in the State of Alaska setting out the Governor’s job and receipt of funds for her personal benefit.
I can’t remember the exact wording as I feel like a bag of dirt with a cold the likes of which I have not had for years!!!
In these hard economic times, where do ordinary people have money to donate to a legal fund to a person who refuses to let go. Whose base does this woman represent? They must be all rich; does she ever ever think of life’s realities out there in the real world? Didn’t she suggest once in a press release about Ashley Judd’s campaign that people who donate their hard-earned cash to such a fund are wasting their money (paraphrasing here). And, what about real needs, like natural disasters, red cross, and of course Alaska’s past winter freeze, and the villages. If anyone were to donate, this should be a priority.
I think I am also going to setup a help Sarah fund too, but I am going to leave out all the “I am sure this is legal, even if unofficial” type language. Think anyone will notice? Donate the proceeds to those damaged by the Governatoress.

And one of those things, and one of her problems is that a lot of her own party are not rushing to defend her actions. That in itself is telling.

Just watched the interview on CBS that Gryphen was good enough to post. I am truly sorry for this kid, who only wants to have proper visitation rights with his son. Can you imagine going into the Palin Den for a nice family visit? I hope he always takes one of his family members along. If so, then she may not be able to utilize the “income” until after she leaves office and maybe not even then.

I’ve come to the conclusion Sarah Palin could do anything, including being caught on video committing murder, and her followers would still love her. They’d convince themselves it was all a liberal media hoax, or that she was justified in killing the victim. My thought would be that as long as the Fund/s are set up while she is in office and they try to rework the rule that she will not be utilizing the fund/s until after out of office, it still remains fact it/they being set up while in office and therefore there would have to be an annual accounting done and claimed by her if it could be shown to be a gift. Even better of course, is the fact that it can’t be done as long as she is gov being a personal benefit and the funds would then be declared illegal and fund/s shut down. It sounds like Sarah has gotten her usual incredibly bad advice re the “legality” of this legal defense fund. More likely, she hasn’t bothered to check out tax ramifications at all. I’m not a tax lawyer, but have a basic knowledge of income & gift taxes. If some knowledgeable CPA or tax specialist knows differently, please jump in and correct me.
If the donations are going directly to her private attorney representing her in her private legal matters, then (1) said attorney must declare the money as income, and (2) Sarah Palin must declare the value of his services as taxable income. The private attorney could “gift” her a small portion per annum – I think the annual gift limit is now $12,000. Private attorney can’t claim to be working “pro bono” (for free) because he’s getting paid.
Let’s play with the numbers a little. If he’s put in $500,000 worth of legal services, and a private fund pays him the full $500,000, he has to declare the $500,000 as taxable income and Sarah owes taxes on $500,000 for services she received from him. If the private legal defense fund only manages to come up with $250,000, he has to pay taxes on the $250,000. If the atty. writes off the remaining $250,000 as a bad business debt, or he “forgives” Sarah the remaining $250,000 – Sarah has still in effect received a total gift of $500,000 in services from the atty. She can knock off the $12,000 as a gift, but she has to pay taxes on $480,000. IRS, are you listening?
Math correction, Sarah would have to pay taxes on $488,00, not $480,000.
And further clarification – “pro bono” services are a gift, and the annual limit on gifts is approximately $12,000.

I’ve seen this strategy used elsewhere too. I complained to an administrator at another website and they removed the “popularity vote” feature. It was a very simple thing to do. It took 5 minutes.
I no longer subscribe to ADN’s newspaper delivery or read their website.
Clearly the trolls are organized– you only need a dozen or fewer of them to pull this off. We need to make this an issue with ADN. They are allowing biased manipulation of the users’ comments by organized groups– ADN owns the article, and the trolls own the user comments.
People from Anchorage try to comment, and then trolls from Florida, Georgia, Texas etc. decide which comments should be allowed and make sure any remarks critical of Palin get snuffed. I’m concerned there may be a very disturbing propaganda war going on that distorts positive comments about Palin. It is kind of similar to how totalitarian regimes in China and North Korea control the information media. With what Palin has said about the first amendment, I doubt she minds this dirty work.
The only thing we can do is complain and write letters to the editor. This reader comment voting “feature” should be removed. Unfortunately I think ADN in some ways is a crummy outfit although apparently they still have some good reporters.

I am sure that as soon as I post this, there will be a minimum donation you must make in order to ue a credit card, but maybe there will not be.
Since credit cards charge a fee for being used, if millions of people donate 1 penny to the fund, that penny will most likely go back to the credit card company leaving lots of paperwork for the fund to process. I hate to see trees wasted if anything has to be printed for this moronic site to keep records, but the idea intrigues me enough to post and see what others think and a way to do it that protects Mama Earth, does not give Palin anything, and just makes the site annoying to maintain.

One last thing: The Department of Law decides whether Palin can receive specific gifts. I guess it is o.k. for her to receive gifts if they don’t influence her government actions. It is my understanding they look at this on a case by case basis.
However she’s already been influenced by national interests (as her position on federal stimulus funds has shown). I wonder if the Department of Law has decided whether Palin’s legal defense fund is permissible– the people who are contributing have already made it clear they are doing so for political reasons and to help her as a national candidate– this “legal defense” fund is a political fund.
I liked some of the comments by Penn lawyer. I was thinking about this from another standpoint as well.
There are laws on the books where, if you commit some crime… you are not allowed to profit from it. Such as by writing a book .IE: People who are in prison.
I think you have to take that to court as well as a separate matter to make sure they don’t profit.
GINO is committing ‘ethics violations’ and by definition not a ‘crime ‘… but both still against the law. I am sure there is a big difference…. by the courts.
But if you did something ‘ethically ‘ that created a big media stir and got attention, this would or could make people donate more to you… based on some ‘impression ‘ they had.
In most cases, you can’t profit from a crime. Ethics behavior vs criminal behavior..? Very ‘gray’ area maybe. Both could generate a ‘ profit ‘ though.
Just some rambling… I have NO legal background.

Is there a difference in the fact that he is a Senator, who’s main work is conducted in Washington and has to adhere to federal ethics laws as set by the House in Washington; Whereas GINO is a Governor of a State and the State Laws are what rules her as to gifts, funds, limits, etc.

I’m a CPA. I don’t generally handle gift taxes too often, but here is my general understanding.
Assuming these legal fees have already been charged to GINO and she’s indebted to the law firm, income from the discharge of indebtedness is included in gross income of the relieved party UNLESS the debt is discharged due to insolvency in a bankruptcy proceeding, the discharge is a GIFT, or a student loan is discharged because the individual fulfilled a service obligation.
My assumption is that this discharge would be considered a gift. Gifts are defined to include any transfer of property, outright or in trust, to the extent it is made without full and adequate consideration. In that case, the gift is taxable to the donor (in this case the law firm). The donee of a gift does not pay tax on gifts nor include them in gross income. As stated above, the firm can exclude $12,000 of a present interest in property to any person during a calendar year from the amount of total gross gifts.
To summarize, she won’t have to pay any taxes on this or have to include it in her gross income. It’s a clever set-up, and I’m sure they probably consulted some specialists in order to set this thing up as a tax shield for the Queen.

McAllister can’t respond to anything that is not related to the Governor’s official duties – thanks to Andree McLeod, who has done such a find job of clarifying the ethical distinction between public and private interest.
I suspect that is why we are hearing from Meg on a regular basis, because everything that has been happening has been about personal drama or politics or both.
I suppose McAllister will speak again as soon as the Governor actually does something in the interest of the State of Alaska.

If I remember right from previous blogs, the Govenor of Alaska can’t accept gifts and can’t earn or accept money other than the Governor’s salary, while in office.
So it looks like either way, gift or income. Sarah can’t access it till she’s out of office.

I think that reference for paying legal bills for her and her family’s issues might have to do with the Dud’s contempt when he didn’t show up to testify in the Troopergate investigation. It ties in to the warthog she put up for AG….
