Legal Defense Fund Goes Rogue! (A Post from the Netherworld)

This doesn’t happen often, but it does occasionally.  I write a post, and then days later I find it in my ‘Draft” folder.  I stare at it for a minute and think “Surely, there’s some mistake.”  I know I posted that!  But, no.  There it is….all dusty and never used, sitting in my closet.  And then comes the inevitable dilemma.  Should I post it now?  Or is it just too late.  So much has happened since I wrote it.  It’s like finding a birthday card or a Christmas card, long after the holiday is over…sitting there with the stamp on, and the address filled in, in some kind of suspended animation.  But, since I have actually been known to send errant Christmas cards as late as June (hangs head in shame)…..here’s my post from days ago.

Just wind back that little clock in your head, and think of it like a little gift from the great blogger beyond.

Remember last night when we learned of Sarah Palin’s Legal Defense Fund?  Not the official one, but the unofficial still (they promise) totally really really legal one?  When you read that post, were you thinking,  ”Methinks the gentleman doth protest too much?”  Did it seem to not be quite….kosher?

Well, Palin spokesperson Meg Stapleton tells us that the governor can’t and won’t accept any money from this new fund.  It is, apparently a ROGUE fund…. (hands over mouth) which, she claims, was set up without her knowledge by Clayton Paslay.  Who is Clayton Paslay?  Some guy who owns a U-Haul dealership in Texas, and says he was inspired by Bill O’Reilly to get all “community organizer” and set up this fund to help.

“It’s not official. Neither the governor nor her attorney can accept monies from a group like this. There is one that is in the process of being established,” said Palin spokeswoman Meg Stapleton.

And what does the gentleman have to say for himself?

“I did this at the suggestion of Fox News, Paslay said.

He said he has never talked to Palin because he can’t get through to her. But a few days ago he spoke briefly with Palin’s Anchorage attorney, Thomas Van Flein. Paslay said the attorney “was in a rush” but didn’t object to the fund. He said they agreed donations could be sent directly to the attorney.

“No different than going down and paying someone else’s parking ticket,” Paslay said.

Van Flein didn’t immediately return calls.

Hmm.  Sounds like nobody is on the same page.  Imagine that.

We can now add another incident to the long and growing list of  back pedaling “Yes, you did!”  “No, I didn’t!”  miscommunication gaffes coming from the governor’s office, or the PAC, or whoever Meg Stapleton is working for.  And if Van Flein has done something questionable in condoning this fund, and it requires that the governor seek legal counsel, does he get to consult himself and charge the governor for it?  Just wondering.

    Alright, so I appear to be upset and all in my previous post. But really, this HAS been covered quite a bit (Huffpost.) Not knocking our AKM at all for blowing off the dust and reposting though (GO AKM.)

    This SHOULD be discussed and reported on.

    Paslay (or whatever in the heck his name is) was all “Palin is exactly what we want”, and talked about how he loved her “maternal” side. (YES, INSERT SNARK HERE.)

    Regardless. The fund he set up is NOT legal.
    Meg- Got it right finally. We can only send our $.01 check to Scarah AFTER they finally get their S**t together.

    I think Levi’s favorable rating is higher than Sarah’s now.

    Any donation fund is legal so long as the receiver, in this case GINO, claims all the money as income so that it’s taxed.

    Actually, she may have to claim it at a higher rate than just income. It’s probably going to be taxed as gifts.

    I think the problem with trying to set up this legal legal legal fund is that it’s actually NOT legal to accept donations without paying taxes on those donations, unless you’re a non-profit organization.

    So, I’m confused…

    Can we setup up a legal fund for Levi Johnston? If it’s really all that easy, I’m gonna do it, but need some guidance. There’s no way he should have to do battle with the Ice Queen and her family of dwarves without some help of his own.

    Anyone know who I can contact to do this or how it’s done. Seriously, I doubt Van Flein will give me any good advice..heh heh. Imagine a high powered D.C. attorney flying in to help him with his custody action.

    AKM, thanks for posting this. I love it when the right hand doesn’t know what the other right hand is doing – there is no left hand where Palin is concerned. Maybe that’s the problem. Too many rights just end up pushing the governor off the plitical cliff.

    All she has to do to duck the taxes is have Obama declare her a disaster area. Once the official recognition of “disaster area” is given IRS has special tax breaks that go into effect.
    Also she would get free food, clothes, blankets, GLASSES, vaccinationsand vouchers from the state and fed governments. She’s a grifter. She should love that.

    Alternatively she could apply for 501c status as a charity. She could be the world’s only one person not for profit organization.

    GINO is trying to cast aspersions on the juudicial council’s ratings system because WAR scored abysmally on it. But it sounds like a pretty fair system. She once again comes off as uninformed about process.

    When Ross-bo was first picked , a poster commented that she looked him up on this link and couldn’t find him. I could not either. The site is highly regarded as a peer review of fellow lawyers. I’m linking the AK. page , but a person could go all over. I asked a lawyer of over 30 yrs. about the site and he said it was an excellent reference.

    austintx–your friend is correct. Martindale evaluates lawyers based on a survey which is pretty extensive. AV ratings are quite good, BV are ok, CV are mediocre.

    Anyone with any experience with or in the legal system can easily see that Ross is a real nothing of a lawyer, not very respected, and with no experience at all in any of the areas for which he will be responsible. He’s not even qualified to act as an Assistant AG, much less the highest lawyer in the state. This is as pure a political hack job as you’ll eve see.

    A divorce lawyer wouldn’t appear to be qualified to embark on a crusade against the Federal government in order to satisfy Palin’s obsession with killing wolves.

    Poor WAR he was polled the too low by his peers and it’s all their fault, lol.

    That attorney poll and articles I read was what I based my citizen VOTE on for our state GA, he rated a 4.5 out of 5, so I’d say he was held in pretty high esteem. Don’t let Palin blow smoke and gloss over something like this.

    I have been checking out the SEE 4 PALIN Pee’ers for about a week now and there are only about 10 to 20 Pee’ers talking Palin up to each other, if anyone slightly disagrees they are eliminated, just like on Survivors.     On April 2, the Alaska Republican Party sent out a press release saying that in light of the charges being dropped against Ted Stevens, “current Senator Mark Begich should resign his position to allow for a new, special election.” That same day, Gov. Sarah Palin (R) said, “I absolutely agree” when asked about the Alaska Republican Party’s request. However, yesterday in a press conference, Palin tried to backtrack:

    “I didn’t call for Begich to step down, either,” Palin said. “I said I absolutely agree that Alaskans deserve a fair, untainted election for the United States senate seat. I’m not splitting hairs on how that happens. I’m saying wonderful, good. I want to see an election that is fair, that isn’t influenced unduly by some announcement that the sitting senator was facing a multi-felony count conviction. That’s what we were told. Now, come to find out, that wasn’t the case.”

    However, if Palin supports a new special election, by state law, Begich “would have to step down.” That process would temporarily leave Alaska with just one active senator. Nevertheless, Palin yesterday insisted that she wasn’t “splitting hairs on how a new election should happen.”

    I’m feeling terribly defeated today. I read Linda’s(Celtic Diva) transcription of the exchange between Ramras and Ross. Like Linda, I was heartened by the questions Ramras asked, but then was sickened by his response of “I look forward to voting yes to confirm you”.
    Are we Alaskans truly powerless? Can Sarah and the legislature do anything they want? I was under the impression that they work for us. If all they want is our vote, but not our voice, then we really don’t live in a democratic society do we?
    I’m hoping that Ramras’s remark was sarcasm, but I doubt it.
    My only consolation is that Sarah Palin may go down in History as the Worst Governor Ever. Maybe.

    The last 2 weeks events have got her steamed. Expects fireworks to go off (and it’s not even the 4th of July yet )…. with many more quotes…. on Camera. (and then retractions…. she didn’t mean THAT )

    Indiana went blue this year!! Palin probably helped push the decent people in the center across to center-left. Any traction Palin might have remaining has been rasped away by her own irresponsible statements and actions.

    Good on that part of the Alaska legislature with backbone for demonstrating some cohesiveness and leadership on behalf of Alaskans.

    I have to say, maybe all this drama coming from the Gov’s office is something that you have come to expect as “normal” in Alaska. But, I have lived in 10 states and I have never seen the kind of lying, back petaling, ethics complaints, media gaffes and just plain drama coming from any other gov.

    It really is NOT normal. It’s insane.
