Legal Schmegal. Palin’s Attorney General on Senate Appointment.
15 04 2009You’re all familiar with the three name switcheroo. Governor Palin decided that instead of choosing from a list of names provided by Democrats, she’d just come up with her own list and make them choose. See, that way, she gets what she wants. Brilliant.
Except if the Senate Democrats aren’t biting. A legal opinion came in this morning stating that this little bit of “strategery” by Palin is actually….illegal. There can be no “list.” She must submit one name at a time. One up, one down. That’s the law.
“There is nothing for us to vote on, there is no appointment,” said Senate Judiciary Chairman Hollis French, an Anchorage Democrat. “The governor has taken an unusual course which is outside the law and leaves us no choice but to ignore what she‘s done.”
Uh oh. The governor doesn’t like being ignored. (crouches under desk, assuming the air raid position)
Of course, the new AG Wannabee, Wayne Anthony Ross, has piped up. He apparently has had a little spare time lately to review this situation, he says there’s nothing illegal about it. He thinks it’s quite appropriate. But he’s going to look over that opinion from Pam Finley, revisor of statutes. just to make sure.
OK, I’m not one to spring things on you without fair warning. So this is your fair warning. Crawl out from under that desk and buckle your seatbelt. Here’s what Palin’s new Attorney General thinks the Senate should do.
“It seems to me the most important thing that can be done by the Senate is not argue with legal or illegal but to appoint somebody to represent Juneau,” said Ross, whose own appointment is up for a confirmation vote by the Legislature tomorrow.
That’s right. No need to focus on that pesky issue of legality, Senators. Just confirm! Why argue if the appointment breaks the law, or doesn’t break the law….I mean come ON…don’t you lawmakers have something better to do than to uphold….the LAW?
I don’t know about the rest of you, but I’m kind of fond of the law. If we didn’t have it, then the lunatics would be running the asylum. We’re actually referred to as “a country of laws.” The fact that there are any legislators in Juneu who are still on the fence about whether to confirm Ross tomorrow is rather stunning. An Attorney General who has better things to do than focus on the law, is almost like a governor who has better things to do than govern.
And speaking of that, where IS our governor during the last few critical days of the Legislative session when we’re still wrangling over things like the stimulus money, the budget, the confirmation of a new Attorney General, and trying to fill an empty Senate seat? She’s speaking at a Right to Life banquet in Indiana.

Progressive Alaska has published another arrogant letter by WAR, this one written in 1993. His letter is responding to “Lawyers Against Discrimination” who were advocating for an Anchorage ordinance prohibiting the city from discriminating on the basis of sexual preference.

Worse than Dan Quayle before her, Alaska Gov. Sarah Palin’s bright star has fast faded in the eyes of Washington Republican officials and analysts, calling into question her efforts to become a national party figure ready to run for the White House. “She’s just not ready for prime time,” said a party strategist who has worked for former President Bush. “I mean, she’s starting to look like she’s having trouble being governor of Alaska.” At issue is her weak debut, hampered by the mishandling of her by Sen. John McCain’s campaign, and subsequent family issues such as the most recent tiff with Levi Johnston, the father of her first grandchild and ex-fiancé of her daughter Bristol.
Since running for vice president with McCain, Palin has made efforts to be a national figure, starting a political action committee and speaking at national events in Washington. But she has also blown other chances, backed out of speech commitments, and allowed herself to be caught in a fight between state and national aides who have different roles for her in mind. While some Republican officials say that there is time for her to recover, many are already looking to others to carry the GOP flag, such as Mitt Romney or Newt Gingrich, in the 2010 and 2012 elections.

Thanks for the support folks, as well as putting up with my inane humor. I hope I have not worn out my welcome on this blog because i enjoyed your posts immensely. Just a theory about the “why” SP would insist on not submitting her list the way that’s expected. Possibly a fierce stubborness to “win” at all cost. It’s not about getting the position filled, it appears it’s about playing chicken and vying to win, just for the mere pleasure of seeing the other side defeated. Like a child would. And then doing the Nelson, Ah-Ha.

So, if Beth K. were really appointed to the Senate seat, that would leave a House seat vacant. It could be amusing to watch Sarah try to fill that position, but honestly the joke’s getting a little old…
Unless there’s a different process for filling a vacated House seat, like maybe the interim AG appoints it???
I infer from a comment waaay upstream that *only* the governor can call a special session of the legislature. Can that be? And an interim appointment, as in Ross as AG, if not confirmed, not just left to dangle like a tea bag, but actually DENIED, stands until another name is put forward. Is that possible? Like Rachel M., I need to be talked down on these two items.

I’m not quite in bed yet. I was watching the CNN News and caught a great story.
It appears that Sarah’s dad (Grampy Palin?) has injected himself into the Palin-Johnston Feud. He wants Levi to spend his tv appearance money on diapers. This Palin stuff couldn’t be more F’d up if it was written by someone tripping (pun intended) on LSD.

Point well taken, but I hope that you’re not referring to all Alaskans as “mindless creatures.” I have found most Alaskans on various blogs (on both side of the aisle, mind you) to be well informed and passionate regarding the issues facing their state.I daresay, even my own Commonwealth has its share of the uninformed. After all, we elected Mittwit Romney as our Governor.
Nevertheless, I believe that Little Miss Sunshine is counting on support not only from Alaskan “mindless creatures”, but those other “mindless creatures” that reside in the Lower 48 if she has national aspirations. I can guaranty, however that she will never capture the Massachusetts vote.

I’d bet that 99% of those Teabaggers make less than $250,000 a year, which means that under Obama and the Democrats they will be getting a nice tax break. Go figure…
What’s really going on here is that Republicans have pretty much been marginalized from positions of power and responsibility, which has effectively freed them up to release their inner demons and treat us to a kind of Theatre of the Absurd. The main beneficiary of this circus is Jon Stewart– he no longer needs to hire paid staff to write his script; he’s having it handed to him free of charge by the likes of the Teabaggers.

Hey guys, not every gOP conservative voted for Mac and Cheesewiz. There were some of us who voted for Obama. Not because were in ‘love’ with him, but because the GOP has run adrift. And we needed someone to help pull the boat back to shore! I don’t like everything Obama has done so far, but Ihave not hated everything either. I’m about 60/40 right now. However, I am every so grateful to those voters who sided with me that Palin was more dangerous than any candidate we’ve ever seen in hisotry. I’m even more grateful we don’t have a sitting vice president doing Jerry Springer, thinking he’s a real talk show host.

Last time I checked the vote on AG is scheduled for 11 am. There is still time to email the entire legislature. Let them know you are all watching what they do. I suggest all please be respectful, to the point & avoid repeating rumor & unfounded facts to them… they’ve heard them all by now.
And any of you Juneauites out there, please send some support to our Senate Dems for standing up to the Gov on this absurd, childish game she is playing with our Senate seat.
Wish you could have all been at the Alaska Folk Festival tonight in Juneau. The “Bluescast” satire group just crucified Palin, her AG pick & all of the recent shenanigins. It was hysterical! I really needed a good laugh.

I was looking for the Alaska Statutes online, and the legislature’s web page has them but I’m not positive they’re the most recent versions. According to AS 24.05.100(a)(2), the legislature can call ITSELF into special session if 2/3 of each house agrees. I’m not sure that the Republicans would want to do that, but who knows. lynnnrockets…..It seems the rules to post on ADN are quite stringent. If you mock, disagree, or laugh at Queen Sarah, they block you and remove your posts without any warning. Today Ross said, ” … it seems that no matter what the governor tries, there is always someone criticizing her.” This is not a matter of criticizing the governor but a matter of her not complying with Alaska Statutes – which are the law. I am no lawyer but when I read the statutes pertaining to this matter, they are very brief, very clear, and written in plain English. They specify “person”, singular not plural. That Ross – a trained attorney vying for the top legal spot in this state – is unable to render a correct “interpretation” on this matter is indeed troubling and brings to question not only the role of his allegiance to Palin but also his lack of scholarly aptitude.
Scary, very scary.

It was a no-brainer for me from the moment she picked him but every time since that he opens his mouth it becomes more & more obvious that he is there primarily to protect Sarah & do her bidding.
No worries about the pesky legalities of what she is doing…why bother with such trivial things.

Just as a context. Austin, Texas had about 1500 Tea Baggers at the Capitol and about the same number at City Hall.
When I was a student at the University of Texas in Austin in the ’60’s we put 20 to 30K students onto the streets of Austin in a five mile peaceful anti-war march. It streatched from the West Mall at Guadalupe down to the Federal Building and back again. The beginning of the marchers met the last ones who were backed up and just coming off the Mall and some rewalked the route.
The only violence was some hard hats on the third floor of a construction site (the J. Frank Dobie Center) protected by a ten foot solid construction fence, throwing bricks at the students walking past.
Those latter are the kind of Americans we need to be afraid of. And that’s the kind of Americans that Fox et al and the RepoTaliban are stirring up. Don’t for moment think that Republicans were joking when they said they were going to turn to insurgency.

I hadn’t seen this reported yet, so if it has, then I apologise for revisiting this information.
On KTUU, a report on this mess with the Governor and the Democratic Legislature, it turns out that the newest pick for the Senate Seat by Palin is Wilson, who as it turns out met the Governor when he was doing remodeling work at the Governors mansion.
It isn’t in the written story, but in the video it is mentioned towards the end.

The Legislature can call itself into special session with that 2/3 vote of each house. Don’t know that they’ll want to, but they may to deal with veto overrides of stim $ if necessary.
The confirmation voting joint floor session is at 11, though there are more appointments than just that of WAR. I’d venture to guess they’ll be out by noonish though.
And, the Bluescast (and many other comments by the MC and musicians) last night at the AFF were FABULOUS (as always!). Great political night there, it was!
