“SO WHAT DOES ALL OF THIS HAVE TO DO WITH THE PRESENT DAY PALIN IMPLOSION?
I think what we are seeing is evidence that the Bush Justice Department had Palin dead-to-rights on this very investigation way back during the vetting process when issues related to the construction of their home first came to light, and the administration engaged in obstruction of justice to have this very matter shelved. Once Holder had time to get up to speed, it became obvious that this obstruction of justice had occurred. So what else triggered Holder’s decision to move on this matter now? A new revelation that is coming to light re: Todd Palin, to which the earlier matter is connected perhaps?
I assume Todd lied during his vetting interview about the foregoing – and about his connections to the secessionist group in Alaska of which he was a member for 7 years. I further suspect that the FBI’s recent investigation into right wing radical groups in the US revealed a membership list including Todd’s name, possibly tied to the illegal movement of weapons for the purpose of forming a militia in Alaska – whose goals could be defined as treasonous, but at the least, fall under the umbrella of the USA Patriot Act where the definition of “Domestic Terrorist” comes into play.
I think it’s a combination of factors linking Todd to misdeeds that are Federal offenses, and you can bet your ass that there is also evidence that the GILF made efforts to protect him that also amounted to obstruction of justice – and, after all, she does have the benefit of living in the lakefront house that was in effect, built with stolen materials. There is a direct quid pro quo linking to Governor to Todd, as once she became Governor, she awarded a fat contract to the firm that provided the materials.
The bigger story is the obvious obstruction of justice by the Bush administration that led to the short circuiting of the FBI vetting process to the extent that the Office Of The Vice President would be subject to blackmail throughout the entire McCain/Palin Administration, had there been one.
Controlling government actions via blackmail…THAT is the story – and a very common one at that. What are the names of the individuals or entities who sought to control to government via blackmail?”
The release is put out right before Shannyn’s show.
Not too cool to be stifling freedom of speech on the 4th of July!
I feel like I keep repeating myself and I apologize if I am, but the public threat of legal action is RIDICULOUS. There are so many other sources for what Palin is threatening Shannyn about. It is a losing case and a waste of time/money.
There is no way that Palin, as a public official, could prove by clear and convincing evidence that the statements Shannyn made were false AND that Shannyn had actual malice (knew they were false or had reckless disregard for the truth) in making them. It really is just a new level of crazy.
More importantly, it is a bully tactic to scare her from speaking. One that a public representative should never use, but especially in light of Palin’s recent actions. Saying that she doesn’t have a leg to stand on is almost an understatement; because if Palin tried to sue and lost, which she would, Shannyn would have a much better case to sue the Palins for defamation.
OMG! Icebergs everywhere! I’m speechless on the last release and the developments of the last week or so with this crazy woman. I do feel badly for her kids.

In order to prove the accusations as false. . . wouldn’t she have to prove that the federal govt wasn’t checking into the WasillaCastle + Wasilla Arena connection – & show there is no connection between the subcontractors, the contractor, and the awarding of the contract. . .and the building of her house? That would mean all satisfied contractor/subcontractor liens on the house would have to be produced *(and those MUST be notarized & dated. . .any false information the notary is liable for jail time & hefty hefty fines) And if she sues Shannnyn, she’d have to sue the others named in her threat – HuffPo, WaPo, etc. . . so that’s a huge can o’ worms there.

I just read the entire press release. WHICH IS CRAZY DETAILED FOR NO REASON. They are building a defense before they need one.
I think, based on the press release alone, Shannyn could arguably sue for defamation herself (a private citizen has a much lower standard/burden of proof to sue for defamation in comparison to a public figure). That is what is so crazy to me. There was no reason for a private citizen to be called out in the national media like that. All Shannyn has done is speculate based on known fact and relay information. If she was purposely spreading a rumor that she knew was false, that would be one thing. But she isn’t. Palin also included the NYT, Washington Post, etc in her scare release – which is like saying the media is not allowed to print any alleged information. No one has said “Sarah Palin DID THIS.” Not yet at least. So what the hell? Palin acts like she is in high school. I am angry about this. I wish Palin would resign from America.

Very interesting stuff. I always wondered if the Palin’s could even get the security clearance to be in the White House considering Todd’s AIP membership. Also, (as reported in Salon.com last Fall) Palin has ties with members of the AIP who helped her start her political career and are on record saying they have an “open door” policy with the Governor.
Those recently leaked email about Palin trying to lie about this issue may have lit a fuse.

There’s a “press release” from “Thomas Van Flein” posted at http://www.conservatives4palin.com/2009/07/statement-from-gov-palins-legal-counsel.html but it does have the SourMan’s byline on it.
I don’t know Van Flein well enough to recognize his style but it sure doesn’t look like what a lawyer would release. And what lawyer works on the fourth of July? (Can Palin really afford the triple time and a half he would charge her for working on July 4th?).
Is anyone familiar enough with SourMan’s style to know if she’s the author? Isn’t it illegal to impersonate a lawyer?
At any rate, they’re threatening Shannyn and anyone else they can with defamation of character. It reads like a thesis on why Palin is innocent, complete with some links and even a FOOTNOTE!
Sorry, but if my lawyer wrote this and released it I’d fire him.

Here in South Buffalo NY , July 4th is all about blowing up every imaginable type of firework and flammable object , and “legal” has nothing to do with it. So, right this moment, as Shannyn began talking, the streets outside began lighting up and going fireworks crazy. Almost sounded like they were welcoming her show onto the air.

Despite the lawyer’s bullying threat, the truth is Sarah Palin doesn’t have the balls to sue. She is a paper tiger.
In a defamation lawsuit the reputation of the person suing is alleged to have been harmed. So, in such a lawsuit, Sarah Palin’s reputation (and how it was supposedly harmed) would be wide open to scrutiny. Also, anybody Sarah Palin sued would automatically be entitled to wide-open discovery — for example, all sorts of correspondence, e-mails and other written communications would have to be produced by Sarah Palin and given to anybody Sarah Palin sued. And, all the people Sarah Palin will have to identify as trial witnesses who could be called to testify about how Sarah Palin’s reputation and how it was supposedly harmed by the rumor that a federal indictment for embezzlement is in Sarah Palin’s future, will have to submit to a pre-trial deposition (that is, answering questions under oath before the trial).
Finally, truth is a complete defense to a defamation lawsuit. So, in other words, in a defamation lawsuit Sarah Palin’s reputation, in essence, would be on trial.
And, if Sarah Palin dared to sue Shannyn (or others) the huge amount of money that will be quickly raised for a legal defense fund for Shannyn (or others) will be jaw dropping. The huge Mudflats community would mobilize in an unprecedented way.
In sum, Sarah Palin’s threat to sue is phony and just another example of Sarah Palin’s desire to play the role of the perpetual victim and try and suppress other people’s freedom of speech rights with bullying but hallow threats.
Like most bullies, Sarah Palin is a coward.

I completely agree with Shannyn on that – frankly those “other sites” are just plain craizy and if people read what they are saying, there is a danger they will get infected with the craizy too!
I don’t give them any clicks – and I don’t think any of us should.
There are sites out there with a right wing view point which are *sane* and have a perspective which is reasonable. Those are the kinds of sites which should be supported, not the sites which come up with bizarre conspiracy theories or sites that purely exist to support one candidate.
The Mudflats is not that – it is not an “anti” palin site and it has never been that. I personally get really upset when someone accuses this site of being Anti-Palin.
It is also not a pro-anyone specific site. There have been times when AKMuckraker (and all of us) disagreed with people who would normally be considered to be “on her side”. There are people who read this site who don’t consider themselves to be on any side at all.
I consider the flats to be a place about Alaskan politics, but it is also a place where the “right” thing is more important than partisan politics. If someone on one side does something “wrong” then AKM is going to call them out on it, regardless of which “side” they are on.
I don’t know if that makes any sense, but I hope it does. And it is just my own opinion.

Glad you are not taking Palin’s threat too seriously. I sure got calls asking what I knew on the housegate scandal yesterday, so if you were reporting that the rumor is out there, you were simply telling the truth. I told my callers that as far as I knew it was just rumor and I neither seen nor heard anything that would confirm it.

just a thought, i am sorry for harping on this. but it is interesting to me that Palin is now making threats of defamation. interesting because i think it is a red flag for the truth.
how many negative things have been said about her, in total? all of which she claims are false. the vanity fair piece? is she saying that all of it is true, since there is no need to raise any concern of defamation? what about david letterman? is he not worthy of her bullying too? it wasn’t defamatory when dave said that her daughter was knocked up by A Rod (clearly untrue and dave knew it was false when he said it). she made it seem like dave was spreading some horrible falsehood. which, if he did knowingly peddle false information, would arguably be defamatory. but now, apparently, palin will NOT stand for remarks from actual journalists and private citizens, such as the alleged housegate rumors, which may be rooted in the truth. we have no way to tell.
this is just a much greater truth that scares the hell out of her and she is acting like an intimidating mobster with legal threats.
the rumors haven’t even really been printed yet! nevertheless, they send out that press release to set up a defense before it was necessary. they jumped the gun. it is telling. and a disgusting bully tactic.

This is so hot air from Palin. I don’t think she knows what taking Shannyn to court over this would involve. It is very easy for Shannyn to defend herself since she has done no wrong. Palin, on the other hand, would be required to produce a LOT of proof. And it would result in the transparency that Palin has fought against all along.

You know? That’s immediately what I thought. The she just confirmed the rumors are true by having her mouthpiece put out this insane attempt to censor free speech on the Fourth of July. Letterman was a gentleman and he apologized, twice, because he didn’t want to hurt a lady’s feelings.
He was under no obligation to do so. He certainly wasn’t going to lose his job, lose sponsors or anything else because he told a bad joke. He did it because he wanted to. Because he’s a nice guy.
I think this has given Palin a false sense of power. Shannyn Moore is not going to shut up and she is not going to apologize. In fact, she stated her position. “Suck it up”. She dared Palin to sue her because she has a long line of lawyers that would like nothing better than to depose Sarah Palin under oath pro bono.
Sarah Palin will never take Shannyn Moore to court for that reason. It’s because…there is fire under that smoke somewhere. And there’s no telling what is going to be uncovered by that whole passel of lawyers that are just drooling to get a piece of Sarah Palin.
It’s a bluff.
And it makes her look even more like the Lunatic Laureate she has just signed up to be.
