Open Thread – Ice Fortress
OK, it’s not really an ice fortress… it’s more like a lovely, eccentric (and very tall) log cabin. Don, our official Mudflats aviator took to the air today and sent back these pictures of an interesting structure somewhere between Anchorage and Talkeetna. I’m guessing there must be one heck of a view from the top floor. I wonder if they have an elevator…
UPDATE: I’ve gotten some additional information, and also have a request. If you do know the location of this incredible structure, please refrain from posting it. We need to respect the privacy and security of the owner. That said, the house is 13 stories tall! The stairs are not in yet, so ladders scale the 152 feet to the top tower room observation deck. Wow.

It surely does look to be a fire-watch tower with a navigation beacon on top, which makes sense looking at the bend of the river and the bits of land that could certainly cause a boat to run aground. Can you imagine the glorious view from the top……….if one had any breathe left by the time all the stairs were climbed?

JS in Chicago posted at the tail end of one of yesterday’s threads and it didn’t generate much response and I thought it worth bringing up again. JSiCh states that Gryphen had mentioned it at IM (I don’t recall seeing it myself) about Bristol filing for sole custody. From looking through the court listing, the initial filings were as Jane Doe against John Doe. Bristol had initially sought to keep the names out of the records, sought closed hearings, sole custody, etc. This all started on 11/4 and the last date is 12/23. The saddest part in my opinion, is that she has also sought a protective order. What the heck are they trying to do to Levi?

The initial motions were filed ex parte–that is, initially without prior notice or any opportunity to respond afforded to Levi.
Before Levi’s attorney even had a chance to enter an appearance on his behalf, Van Flein already had filed, and the Court had denied, a slew of motions seeking: (1) to have Levi held in contempt; (2) to have Levi pay Bristol’s legal fees & costs; and (3) to shorten Levi’s statutory time to responsd to the petition for custody. On December 9, Rex Butler filed an answer to the petition for custody. That of course has not been ruled on, and will be the subject of the custody proceedings Van Flein unsuccessfully sought to close and keep from the public record by use of pseudonyms.
Following that, on December 23, there was a flurry of filings: the Court received from Van Flein a reply to Butler’s oppositions to the ex parte motions (and appears to have denied Van Flein’s request for oral argument on those motions), but denied all of Van Flein’s ex parte motions–not only the motions to substitute pseudonyms, but also the motions to close the proceedings and for protective orders.
It is not entirely clear from the docket entry, but it appears that on December 23 Van Flein also applied for an extension of time in which to file his own reply to Butler’s answer to the petition for custody. If so, it appears that Van Flein is asking for more time to respond to a (responsive) filing for which he unsuccessfully asked the Court to shorten the period of time granted to Levi to respond.
Let’s just say it’s my impression that an extraordinary amount of lawyer hours are being devoted to generating a flood of procedural motions against a nineteen-year-old boy.
It looks like a whimsy of someone’s imagination. At ten stories though it lets me out from climbing it. My NYC son’s last apartment was a fifth floor walkup. I saw it twice. His new apartment is a 4th floor walk up. Haven’t seen that one yet, might wait until he’s on the 3rd floor and lower.

LiladyNY – Thanks so much for clarifying all that legal jargon! I rarely go on the IM site as I usually get an alert that my computer is being compromised and then the darn thing locks up on me!
I am VERY glad to hear that the Judge ruled against Van Flein’s attempts to rush and hide their actions. It makes sense for Levi to not being living with his mother at this point, as her status is a big target for the Palins – although it shouldn’t be. Having contact with her grandchild could well be one of the best things to help Sherry deal with her drug and legal issues.
Although Levi has had some income, it probably isn’t such a huge amount that will last through what will probably be a lengthy and expensive custody battle. If a legal fund is set up for him, I’ll be right there donating.
Let’s hope the Judge continues to be fair – there certainly won’t be any decency coming from the Palin camp. I feel sadness for Bristol and Levi and their baby. Custody battles are terrible for the average person, but living in the limelight plus being saddled with Sarah Palin, must be a nightmare.

I used to have the same problems over there when I was using the updated version of Firefox. Lots of odd, frustrating things were happening and I was always a big fan of Firefox until then.
I’ve been using Opera and it is clean and simple (really simple) and really nice. Plus, no further problems at IM.

For those who don’t know about Willow – back in the mid-1970s, there was an interest in moving the capital from Juneau to Willow. I don’t remember the details, but the motion was defeated, or no money, or some such.
If the capital had actually moved, I wonder if Palin would still have found some excuse to stay at her own home and collect per diem, even though Willow is just miles from Wasilla.

Hey! Remember WAR, the failed candidate SP thought would make a dorn-tootin’ great AK Attorney General? Didn’t he specialize in helping dads defend their rights to be in their kids’ lives in divorce/custody proceedings?
I betcha he’s already lined up on Levi’s side and will be writing an Op-ed in the ADN about how important it is for kids to have their dads.

What a nice, esoteric building. I don’t think a wooden structure would suffice as a fire tower, tho. The top could hide/mask the presence of cellular telephone transmitters.
As for the filings in the Bristol-Levi matter, it is just a down-right rotten and dirty thing to file motions right before Christmas.
As for the matter of ex parte , it’s not the motion that is ex parte but the hearing. Nearly all motions, except those rare critters marked as joint motions, are technically ex parte. What the phrase really means is “without the other party” – with the usual reference to a hearing or meeting with the judge without the other or opposing party being present. If I read the comments correctly (is there a link to the docket listing?), Bristol wants to present her side of the story to the judge without Levi being present to give his or to refute hers. It’s a fairly typical tactic in custody matters but it’s especially egregious in this instance because of the timing of the filing(s).
Guess the daughter is as transparent as is the mother. Apple, tree, not much of a fall.
Hopefully this all gets Levi so mad that he will finally come forward with all the “dirt” he has on Sarah. Seems like he has a loaded cannon, and this might be the fuse that sets it off.

What a wonderful expression of personal creativity! It’s wondrous what the imagination is capable of creating when not suppressed by the severe constraints of conformity. Here in the Tucson area (Pima County), I can’t legally put up a porch light or a garden fence w/out paying for a permit and having some porch light expert or garden fence expert approve my plan, and then having the completed work inspected to be sure I didn’t deviate from the plan (never mind that in the course of doing the work I had three better ideas – they’ll have to wait until the inspector’s gone). All that’s for my own good, of course. It’s distressing to me that it’s a system concocted by my fellow liberals, a county government transformed into an intrusive and repressive Homeowners Association. It’s a perfect reflection of every libertarian criticism of liberals and the unnecessary interference of government in the lives of individuals. Despite the offense taken by my own libertarian streak, it’s even more distressing to have to concede the point (or any other) to the local Teabaggers, but I cannot refute that our county government is an example of a liberal government that tramples individual freedom in favor of an imposed social order. It saddens me to know that such a wonderfully creative expression as the Tower House could not exist here.
Kudos to the creators of the Tower House – it is a triumph of imagination and spirit. And thanks to Alaskans for having the respect for your fellow man necessary for such a wonderful personal expression to exist. It stands as a good reminder for all of us that the freedom to experience the fullness of our own humanity – eccentricities included – should supersede the social convenience of imposing conformity on each other.
Now, how about a Gazebo?

Okay… read the docket. Nothing unusual. What would be helpful instead of rank speculation is for someone to go to the courthouse, get copies and post… let’s see what the filings actually show.
My guess is the windows are made out of lexan for strength and to withstand the weather. Most likely, the windows do not get washed regularly. Plexiglass gets scratched easily. Not sure about Lexan.
That’s a really nice piece of folk art, but unless there’s a bunch of structural steel expertly embedded in its core, it would be a very dangerous place to be in an earthquake or a windstorm.
Maybe the owner could rent it out to the Palins, at very favorable rates, as a vacation hideaway.
Or maybe the Palins are the owners. Todd might have built this with his buddies.

Meg Stapleton has responded to the claims that Sarah & Todd Palin did not report the threats of gang rape against Willow:
One of the events discussed in former Gov. Sarah Palin’s book, “Going Rogue, ” was a disturbing occurrence that affected the family: a vile threat made against Palin’s daughter, Willow, while she was attending school in Juneau.
The threat was made in a MySpace post.
The family reported the threat to the governor’s security detail and they investigated the matter, including interviewing the individual who made the threat at that person’s home.
Though no charges were brought, the Palin family remained very concerned. The matter involved minors and was likely not subject to public review. A reporter for the Juneau Empire was directed to talk with the governor’s security detail. It is not clear whether he did so. Contrary to the implication of the report, the threat was real, the threat was serious and the threat was responded to.

So despite the fact that the AK Troopers statement that they have no record of this, along with the local police and the school system, Meg is now claiming that the security detail ( the AK Troopers) were indeed informed of this event.
Why do I find that difficult to believe? No one remembers this except Sarah, Todd and Van FLein (who stated he remember Todd telling him about it)? Two members of the Governor’s family were threatened to the point that the Governor (who at the time had a 80% popularity rating) feared for their safety and no one remembers it? Even if the threats turned out to be nothing more than childish talk on a myspace page, this kind of thing is simply not recorded or remembered by anyone? Does that not strike you as odd?
I might be way off base but this custody thing makes me think princess winky has met her waterloo. Like I said, I don’t know why but I think her time has come and there’s nothing she can do to prevent the “big fall.” Time will tell.
Re: The Levi-Bristol saga
Can it be any coincidence that this was filed right on the heels of Levi’s appearance in Playgirl? There are a few things about the timing that strike me — Levi has not yet likely made enough money to withstand a lengthy court battle w/out it breaking him, the Playgirl appearance can be used as ammo in an attack on his moral character and fitness as a parent, and, by striking first, S’arah has put Levi in a position where she can claim anything he says about her now is a lie motivated by his anger over the custody battle – and that’s enough plausible deniability to satisfy the sheeple who follow her.

I grew up ten miles from this house. The guy is a lawyer and the house is right off a set of railroad tracks. You can see it from the highway on a long straight away, but many who see it just think it’s just a long (rogue, hee-hee) tree. It teeters in the wind near the top floor. He’s quite secretive about his tower house.
The judge hearing the case was appointed by Murkowski not Palin. She also was the judge on the Diane Palin case. There is another judge in Palmer with the last name of Heath…don’t know if that judge is related to Queen Quitter.
The Honorable Judge Kristiansen was also the one reported to have heard Diana Palin’s not-guilty plea last (was it April?) when she was allegedly caught red-handed allegedly breaking-and-entering someone’s home with a daughter allegedly in tow, although a different judge seems to have been handling the case ever since….

Does anyone know Kari Kristensen? She’s the judge in the custody case. She has already denied Van Flea’s motions to use pseudonyms for Bristol and Levi (usually only granted for the minor in these cases), and also a motion for a “restraining” order. This is going to be an interesting case. I can’t see where the fact that Levi posed for Playgirl to be a mitigating factor or lots of celebrities would lose their kids in their line of work. It will be behavior AFTER the child’s birth that will mitigate, such as the Palins’ attempts to restrict visitation to Levi, etc. and Levi’s support payments (is there even a court order for that? otherwise, his payments are voluntary and he has made them, from what I understand). They’ll look at each parent’s ability to maintain a home, parenting skills, etc. Hopefully, Rex Butler knows a skilled family court practitioner Levi can hire. Van Flea isn’t one, BTW, so unless he’s as greedy as Her Nibs, he’ll move aside. I don’t see why there would be a problem with joint custody or generous visitation for Levi–whatever he wants. But then, surely we’ll have Her Majesty interfering in the background. But surprise! The wishes of grandparents generally don’t count; let’s see how much they can lie, though.

The tower reminds me of our visit to the Winchester House in San Jose, CA. She was an heiress to the Winchester Rifle fortune. At some time in her life, she was given the prophecy that as long as she kept building her house, she would stay alive. Stop construction, and her life would be over. (Turned out that she died while they were working on the house, darn prophecy).
As a result, there are door ways and windows that open to the solid wall of a room addition. There are stairways that go nowhere, sometimes several staircases in one room. Some of the construction was based on what she thought were lucky numbers. The outside looks like a big old Victorian mansion. There are a few interior images on Google images; they do not allow photography in the Winchester house.

That is what it looks like. I am not 100% sure, but you figure that Sarah had to have known about all this going on, especially considering it is her personal lawyer who is handling Bristol’s case, and then we know that Sarah went onto Oprah telling her that Levi would be welcome to join them for Thanksgiving (all the while knowing that Bristol had filed a protective order against Levi) and how much Levi was loved and needed love. Just goes to show you that Sarah is a nasty little so and so who can’t be trusted on any front.
So many times family members create issues for unwed parents – on both sides of the family. Everyone wanting their piece without the other.
Having a fair & impartial (key words there) court decree is in the best interest of the child AND parents to determine visitation / holidays / birthdays etc. Jointly raising a child requires long term planning, unfortunately, many couples wait until bitter feelings before obtaining a stable resolution to custody.
I feel that Levi will be fighting this battle for the next 18+ years. Since Palins seem to treat him as only a sperm donor – not a formerly engaged couple, with a fairly long term relationship.
How sad to be raised with anger & disgust toward whichever person he is not with at the moment. The Court should protect this child by having every relative in that courtroom – and understand what effect their anger will have on that child. (Grandparents, Great Grandparents, Aunts, Uncles, etc)

SPs unequivocal characterization of Levi’s adventure(s) into the world of magazine photos as “pron” [reverse the two middle letters] makes complete sense, now! Of ALL the words she could have chosen to respond to the question [was it Oprah's?] about Levi –and if he would be having Thanksgiving with the Palin family– she chose that one.
She knew Van F would be filing for Bristol’s sole custody and she was making a preemptive strike; not many judges look favorably on one of the parties in a custody case being ‘in the pron business’. In most cases, probably 99.92% of the time, that would be an automatic disqualifier for awarding of custody.
Too bad the librul media and the Alaska bloggers apparently ‘got to’ the judge, first, and the judge isn’t rolling over to the Van F/Palin request without first allowing due process for both of the parental parties.
Dang, if the totally biased librul media and AK bloggers would just “quit makin’ things up” to poison the mind of the judge(s), there would be no problem – no delay. See, it’s also all their fault, too. beth.

The choice of location with two seemingly unobstructed views at an angular ‘turning point’ argues for this idea. There are a vertically regular series of ‘floors’ apparently of steel, with the ‘infill-panels’ of wood being somewhat ‘artistically irregular’ in placement horizontally. Summary: I think it’s a camouflaged, for what ever reason (including creative ‘adaptive reuse’), (old?) microwave relay tower… although I do not know if current technology still requires the ‘antenna bowls’ for the receiving and relay antennae.

I doubt that it would make a difference within the Palin family. They have already been through this with the custody of Molly & Trooper Wooten’s child/children. Sarah and her family were ordered to stop disparaging Trooper Wooten on more than one occasion and it got so bad that the Judge in the case told Molly that if it did not stop it would cause her to lose custody of her children. Given that information, I seriously doubt that the Palin/Heath family will change their M.O., since we know that Sarah and her family did not stop disparaging Trooper Wooten and continue to do so to this day.
Haven’t heard much from silly sarah’s protege, Carrie Prejean since her self sex tape(s) hit the nets. They appear to be cut from the same cloth, too stupid to know what they don’t know. I would say sarah’s little friend carrie’s tapes were quite a bit more graphic than Levi’s playgirl spread. Gee, sarah look at who you pal around with and send little notes of approval and encouragement to. Hope your girls don’t consider her a role model.

Sarah went on the Oprah show knowing full well that Bristol had already filed for custody and filed a protective order against Levi. Those filings were done long before Sarah went on the Oprah show.
Her behavior on Oprah towards Levi was a set up to make her look like a loving concerned grandmother.
HonestyinGov-Yup, Sarah’s pretend dairy is still getting help from the State in special favors and special “loans”…wink wink. Is it really a loan when you don’t make any payments on the “loan?” I think that is a “grant!” The CEO of that new dairy, Karen Lee Olson, defaulted on a $2,000,000 dairy loan years ago and she is back for more.

Being a male and having gone through a custody case, I can unequivolly state, as any attorney would most likely agree, that Van Fless is being an axxhoxx. I get the impression he is trying to escalate Levi’s legal fees by entering excessive legal motions. I hope this judge is also fair and not influence in anyway by the Palin’s and who Sarah might know. So far she seems to be fair. I wonder how well the records are being kept by Van Flees inorder to separate Sarah’s fees from the custody case. It believe it would be a great idea to set up a legal fund for Levi. Evan if you don’t like everything he does, at least it would essure that he has the funds available to fight a fair and costly custody battle which is costly to begin with, but can get more costly if lawyers like Van Flees use tactics to try outlast him by increasing the his legal cost. This is not an uncommon tactic. If they’re any excess in the funds left over after Levi’s case is over, the funds could go to towards another worth while cause. It would just need someone to control it and to ensure the money is used properly.
By the way, although it took 3 1/2 years for my case to end, I eventually won custody of my two young girls and that was, wait for it……..over 25 years ago. I just couldn’t resist putting in a little AK Muckraker in on a serious subject.
I say depose sarah in the custody battle.

Can any of you l-eagles out there explain the difference between a protective order and a restraining order in a case like this?
Can a protective order be solely for the purpose of protecting sensitive information from being revealed on the part of the plaintiff? (I.e. could they be trying to avoid having certain information about certain people close to the plaintiff (guess who) being brought into the case?
Using this to protect Sarah’s secrets makes more sense to me than trying to protect someone against Levi (or Sherry).

Unfortunately, the court probably won’t take into consideration Previous History of the Palin/Heath Clans actions until later – However, can hope that one judge will talk to another to relay what occurred on previous case with some of the same “non-participants”

@82 — The statute you referenced relates to domestic violence and sexual assault. I was wondering about the use of protective orders in regard to other matters. If that’s not the case in AK, I shudder to think about the implications here.
The court docket shows that Levi supposedly violated a court order, and they tried to hold him in contempt. I hope this is not related to the protective order, but who knows what they could be accusing him of. I wouldn’t put anything past this family when it comes to vilifying other people for their own personal gain. They certainly have a long provable history of doing just that.

Bristol files for Sole Custody of Tripp. In court proceedings Van Flein calls Tripp “Tripp Johnston Palin” and tires to keep the hearing closed but Levi fights back saying he thinks he and Bristol will have an easier time if the proceedings are open because it will keep Sarah Palin from future meddling in the situation, and “he theorized that the closed proceedings might be intended to conceal some “fairly aggressive” tactics”.

megacephalus — I’m running Ubuntu Linux on both my laptop and desktop, and am really quite happy with it. I still have a couple Win apps that I keep Win XP on my desktop for (it’s been dual boot for a couple years), but other than that I use Linux all the time. It consumes a lot less of the processor time than Win does, and w/ out the need for an anti-virus program (viruses are a Windows problem), it gains even more productivity. And Free Software – I like free software. It’s sort of a hobby, but I make a little money at it – I buy computer components through eBay and a couple other sources and build computers to sell. All those go out loaded w/ Ubuntu Linux and a selection of freebies. Openoffice.org, a free office software package from Sun Microsystems, is compatible w/ MS Office and is also available free for Windows in case some haven’t discovered it yet.

For those who might want to try Ubuntu, usually Borders has the Ubuntu Live CDs – you can boot from the CD and get a look at Ubuntu w/ out having to install it. It includes Firefox and some other software you can use while running from the CD. Borders also has a $10 Ubuntu Pocket Guide – there is a bit of a learning curve, but it’s not bad. I look for a lot more people to make the switch when MS drops support for XP and people are faced the choice of yet another $100+ OS or a free one.

to Nan #89 – that is quite a story! It angers me no end when a man hits a woman or a child since this reinforces the feeling of worthlessness and weakness. We should be lifting up our people, not putting fear into their life and making this an approved way to interact with others.
I’ve been fighting back with friends lately when they make stupid comments about others groups of people, be it related to skin color, religion, dress, etc. I never used to speak up, but after listening to everyone on these Alaskan blogs, my voice is beginning to be raised. Of course, it is not listened to – but it is a start and if I keep it up either I will lose the friend, the friend will no longer talk this way around me, or maybe s/he will begin to think differently. I wish for the last result, but would live with the middle idea so I don’t have to be vigilant in calling these ideas out.
Matalin had another argument on HP today about Bush inheriting 9/11 – and I couldn’t believe her face. It didn’t move when she spoke, and her lips didn’t move – just opened a tiny bit. It was truly sad. I was so in awe that a voice could be heard with no facial action that I almost missed her words!
I appears that we are in for a long, hard, slog – and with the threat today from Al Queda that they are going to do something really big soon, it won’t get any easier.

JS @ 83 – read the news article at the link posted by Eye @ 87, especially the following paragraph as it shows the contempt effort was for Levi commenting publicly on the case; the effort was denied because while the case file was made temporarily unavailable to the public, the parties were free to comment on the matter after the judge denied van flea’s “protective gag order” attempt. Let’s not be so quick that there is any credible reason for a protective order related to the child as that leaves the unfair insinuation that Levi has done something wrong.
Palin’s attorney, Thomas Van Flein, filed a motion in November requesting a hearing to hold Johnston in contempt based on public statements he’d made about the case; however, Kristiansen denied the motion, stating that the court had closed the custody proceedings at Palin’s request, but had not granted a request for a protective gag order. In other words, while the public couldn’t access the court file, the parties were free to talk about it to anyone they liked.

I tried Ubuntu and had major problems installing from the free cd(I strongly suspect from clueless computer challenged grandma issues).I was left with a start screen that asks if I want to boot xp or Ubuntu.Ubuntu seems to not be a complete system and I cannot use it.tried re installing,but I cant get rid of the damaged system I installed.Xp still works fine.
Wish I had a clue.
