Palin Supporters Encourage Harassment of Alaska Judges? Palin v. Johnston Custody Case Takes a Nasty Turn.

Just when you thought things couldn’t sink any lower, they drain the pool and start digging.

There are new developments in the recently disclosed Bristol Palin v. Levi Johnston custody case.  The Palin half of Palin v. Johnston wanted to keep the identities of the parties pseudonymous – Jane and John Doe. Of course,  a custody hearing in Wasilla, Alaska between Jane Doe represented by Palin’s high-profile lawyer, and John Doe represented by Johnston’s equally high-profile lawyer couldn’t have stayed off the radar for long.

Palin’s argument was that the case would be traumatic for their 12-month old son Tripp. Johnston claimed that the trial, if kept secret, would allow the Palins to operate under the radar, allowing potential bad behavior from Sarah Palin in particular to occur out of the sunlight.

“I know that public scrutiny will simplify this matter and act as a check against anyone’s need to be overly vindictive, aggressive or malicious, not that Bristol would ever be that way, nor that I would. But her mother is powerful, politically ambitious and has a reputation for being extremely vindictive,” Johnston said in his affidavit. “So, I think a public case might go a long way in reducing Sarah Palin’s instinct to attack.”

His attorney, Rex Butler notes:

Embarrasing facts sometimes present themselves in cases involving custody. If the legislature chose to make any trial involving embarrasing facts subject to closure, nearly all the domestic violence hearings in this state would be sealed and private. This case presents a custody case with similar facts that attend open cases every day in the Alaska Court System. The plaintiff has failed to meet the test for either closure or the use of pseudonyms or a protective order and has not identified an evidentiary basis upon which to find closure necessary under a privilege rationale or for any other reason.

The judge ruled for open proceedings.

Sarah Palin’s group of supporters including controversial conservative radio shock jock Eddie Burke, and (you can’t make this stuff up) Palin’s Wasilla hairdresser, have decided to take action and help promote a campaign seemingly designed to harass the judges involved in Tripp’s custody case.

We want to thank everyone for their time and attention to this matter. Over the Holidays; Superior Court Judge Kari C. Kristiansen issued a ruling under the authority of Superior Court Judge Sharon Gleason. The ruling was a denial to keep the Custody dispute Between Bristol Palin and Levi Johnston over 1 year old Tripp closed.

Judge Kristiansen sited there was no reason to keep this matter private. The Palin’s trying to keep the proceedings focused on Tripp, fought for the closing of the proceedings. Levi Johnston argued for an open proceeding. The Decision raises many concerns of Political Hanky Panky; but even more, cannot be justified to be in the best interest of a 1 year old child.

Both of the Judges are appointees of Former Governor Tony Knowles–(Democrat). Both of the Judges are up for retention. Fancy for Re-Appointment in 2010.  [<---Editor's pick for best sentence in Facebook post] Both have been accused of activist liberal rulings prior.

The Law in Alaska without doubt provides for the closing of a proceeding. The best interest of the child, or other mitigating circumstances is the guide. There is no question both elements are in play here.

We here believe this decision is either one of the worst in Alaskan History; or is in fact: a Politically motivated attempt to harm or perhaps payback Sarah Palin. Perhaps elements of both could also be correct. Barracuda Brigade for Our American Girl! 2012 has decided, since the Judges want a public proceeding; to give them one.

The Judicial Review Commission of Alaska is set-up in a way, that any protest to them would be handled in this situation by: Judge Sharon Gleason—yep–that is why she had Judge Kristiansen hand down the decision.

The “Tripp is not a Political Football” protest will formally begin on Thursday Jan. 7th at 12pm. cst. We ask all concerned to call, fax and e-mail Governor Parnell: also to call and write both Judges and let them know: Patriots across America find your actions a disgrace to the Judicial system. That our concerns are being directed to the Governor’s Office.

A formal protest of a custody case, including apparent telephone harassment and the identification of the physical location of judges by “patriots across America?” Whipping up a political frenzy while claiming the best interest of the child you’re trying to protect from a political frenzy?

Local political watchdog Linda Kellen Biegel at the blog Blue Oasis, who has frequently been on the receiving end of the wrath of Palin supporters was concerned enough to craft the following letter to a number of law enforcement agencies in the state:

“I was not sure who has jurisdiction over this issue, but I wanted folks to be aware that there is a push across the Internet involving Facebook and Twitter (and now posted on Sarah Palin’s Facebook page) to contact/harass the two Judges in the Palin v. Johnston custody case: Superior Court Judge Kari Kristiansen in Palmer and Presiding Judge Sharon Gleason in Anchorage.

They have their office phone numbers and the Anchorage office address published on a Facebook Fan Page and are encouraging everyone to start contacting them on January 7th through a Facebook “protest” page.

As someone who still receives regular (almost daily) harassment from these folks, I know that it isn’t a question of “if” but “when” someone actually makes a threat against one or both of these judges.

Biegel notes the recent report discussed on CNN and the AP regarding the spike in threats against judges and prosecutors.

The report by Justice Department Inspector General Glenn Fine concluded there are still major gaps in reporting and responding to threats. Concerns about security for judges intensified five years ago after the husband and mother of a federal judge in Chicago were killed by a man angry over a court ruling.

Between 2003 and 2008, the number of threats and inappropriate communications jumped from 592 to 1,278, the report found. The government defines “inappropriate communications” as messages that aren’t explicitly threatening but worrisome enough to require further investigation.

What will actually happen on January 7th at noon Central Standard Time remains to be seen, but one thing in certain. Sarah Palin’s divisive influence and ability to fan the flames of anger and vitriol among her supporters continues, and enters uncharted territory. Let’s hope we see a Facebook post from her condemning this national campaign against Alaskan judges.

    If neither is with you, have grammy whip up her nutty base of people who have no standing in the process and sic them on the neutral arbiters who will deciding who should have custody of your baby.

    I believe that making threats against judges is a federal offense. Please correct me if I am wrong, but if these rabid supporters go too far, as they have previously with Linda, then I think they will be receiving some visits from not so cordial law enforcement officials.

    There is a way to advocate for a position without this type of viral hatred and anger spewing forth.

    Even an educated person can become an ignorant buffoon when engrossed within the hatred of the Palin world. What is it about that world that drives them to become the lowest common denominator. (pondering only, one has to even Try to answer That one!) LOL

    Seattlefan, seems right to me. I would like to hear a legal opinion on this too. I can’t imagine that it’s legal to harass a judge, try and influence them, and encourage others to call by posting their numbers online. This is a civil matter, no less.

    How can this possibly have any effect on a one year old child. If the child is there, he will hear the fighting anyway- I would hope they would keep him home. If he isn’t there the child is one year old- who is going to tell him what the press is saying and explain it to him? He isn’t in preschool or school- this can’t be about protecting the child. He won’t be old enough to understand this stuff for many years and by then it will be old news. Anyone can see who this is about.
    $arah wants to protect her privacy and her vindictiveness. I hope they keep it public so she will have to rein in her mouth. I can bet that it will become sealed- if it goes to Parnell. They still haven’t released the e-mails. This is more of the same.

    In Pennsylvania, and I expect in Alaska and all the other states, lawyers who appear before trial judges (whether in criminal court, civil court, family court), appellate judges, or administrative law judges/bankruptcy judges – learn very quickly that if you publicly criticize, ridicule, file an ethics complaint against, or in any manner attack a judge, his or her fellow judges band together and there will be severe, albeit unofficial negative consequences for you, your present client, your future clients and the rest of the lawyers in your law firm, along with their clients. The judicial system demands unquestioning (and yes, sometimes undeserved) respect and decorum from participants.

    As an example of how extreme this judicial circle-the-wagon-mentality is, in Pennsylvania, the state Judicial Conduct Board is charged with investigating claims of misconduct by judges. In 2006, they received numerous complaints and information that two “rogue” judges had sentenced hundreds of teenagers found guilty of relatively minor charges (like truancy) to a privately operated detention facility, which gave the judges payoffs. The Judicial Conduct Board passed along the complaints to federal prosecutors but allowed the two judges to continue to remain on the bench for two years, during which time hundreds more youths were unfairly sent to jails or detention facilities. The 2 ex judges pleaded guilty but the US District Judge rejected the plea deals, ruling that the judges hadn’t accepted responsibility for their actions. They are awaiting trial on federal racketeering charges.

    In the Palin v. Johnston case, the judge seems to be equitably holding the ex-governor’s daughter to the same standard as applies to everyone else under state law and judicial procedure.

    If Palin’s whackjob supporters follow through on this, I think it will contribute to a negative outcome for the Palins in this custody case and in any other cases they are or may become party to in the Alaskan court system.

    I usually don’t comment on $P’s appearance (except on the remarkably flat belly during “pregnancy”) but one of my two favorite comments from last fall was from someone with Granny or Grandma in her name who posted about $P something along the lines of “this is what happens when you let a straight do your hair” which cracks me up every time I think of it.

    That photo of the Beehive woman is not a good ad for her services, whatever they might be. If her services include doing something illegal, I hope the local law enforcement grows some b@lls and does something about doing their law enforcement job.

    (The other favorite comment was from MadSkillz Son and was about the “GOP going down like a cheap hooker”, and lo and behold, they have, and as AKM said, they drained the pool and kept digging.)

She has more important things to write about, such as her in-depth knowledge of terrorism and foreign affairs (IM has her post).     Not likely that Palin will denounce this effort since she has allowed them to promote this protest group on her Facebook page since 1/4/10 @ 3:56 PM. I reported the posting to her moderator on 1/5/10 at approximately 1:30 CST and the post is still there.

    None of these callers are going to get through to the actual judges, of course. They will be speaking with/ e-mailing to front line court workers whose job it is to filter out the nuts, report questionable and threatening messages to the proper authorities, and pass on only legitimate court business to the judges. And these court workers tend to be very good at their jobs and professional. However, the judges will know it is happening because it is also these court workers’ job to let them know.

    Mr. Van Flein may discover that he gets a very frosty reception the next time he appears on any matter, Palin-related or not, if he does not take steps to stop this “protest”.

    Oh, and there WILL be increased court security because of this. In Canada, that has included RCMP sharpshooters posted and friskings for all (including lawyers and clients) in addition to the usual metal detectors. What might happen in the trigger happy US I could not guess.

    Regarding her hairstylist…I do believe that woman thinks she is a celebrity. Good Gawd, she can’t even “do” hair in a style from this century. Hillbilly Hair is what she should call her shop.

    I think the Palin’s are accustomed to getting their way and bullying everyone who stands in their way. But guess what? She is no longer the governor…she quit. She has no power. She may find that she can’t bully the judges. Well, let’s hope.

    Geez, so now the lemmings are pulling the Orly Taitz move on judges in Alaska. Just last year Orly’s loon followers did the exact same thing to a Federal judge: Judge Carter in the 9th circuit. Needless to say his court personnel deflected the calls and faxes and emails but the judge WAS made aware. In fact he lambasted Taitz in court for their behavior, told her to tell them to knock it off and stated that any calls from said people would go directly to answering machine and then deleted! It was great theater and did not end well for Taitz. Taitz’s goons also pulled the same stuff with Judge Land in GA Fed district. In fact one of the loons challenged the judge to fisticuffs on the court house steps! Again all did not go well for Taitz.

    Sarah’s minions would do well to learn from those 2 examples. Judges do not take kindly to an utter lack of respect and many do make the lawyer pay. I hope they realize that the only person that could possibly be hurt by this could be Bristol.

    So now Sarah’s minions will be known as the followers of Sarah Orly Taitz Barracuda Palin…unhinged, dangerous and incredibly stupid.

I cannot wait for Levi to expose the truth on Bristol’s alleged drug use, alcohol abuse, and what the Palin family is really like.     Some good comments here and this is an interesting case in point.

    We know that as governor an involved party abused her power to influence law enforcement in an extrajudicial fashion in a similar case but got away with it entirely.

    This “activism” simply substantiates and underscores the apprehensions expressed by Johnston arguing against anonymity. However, all evidence points to the foregone conclusion on the part of the ex-governor that she will get away with it again.

    Before anyone becomes overly optimistic about the unimpeachability of the judicial branch I refer you to the heinous “not to be taken as precedent” decision of the SCOTUS that appointed the worst president in history.

    Not that this case will ever rise to that level. Like all delusional tyrants it takes time and experience to fine tune the ability to incite a minority of fanatics to intimidate a majority of people who just want to be left alone.

    I am only speculating here, but I think the custody issue is indeed very important to the Palins because it is their desire that they have a free hand in indoctrinating the child with their dominionist religion and sense of self-righteous infallability.

    I am more interested in the outcome of the evironmental meeting tonight but I couldn’t resist making a comment on this because it is so outrageous.

    A judge’s decision to hold a custody hearing open to the public is the law practicing, deciding, upholding what they deem right for an innocent child.

    This is a very serious issue. I am going to recommend some reading on a previous case that sounds like this one. The story begins in 2000 when Matthew Hale, a white supremacist leader came before Judge Joan Lefkow in Chicago.

    During the case, internet threats were placed against the judge’s family, with her address and photos of her family posted on-line by members of Hale’s group. Long story short, after five years, death threats and guards, Judge Lefkow came home in 2005 to find her mother and husband murdered. The man was eventually found, committed suicide confessing to the murder, and claiming to have found the information on-line. (He had his own grudge against the judge). Lefkow has testified to Congress about the problems of providing protection to judges who have been threatened.

    Reports abound of other judges who have received threats from many different people and places. This is just one very sad example. And, it ought to serve as a warning to the people posting threats and addresses that actions have consequences. The threats to judges are a way to subvert the legal system.

    I think that Palin’s currency is a direct consequence of that kind of stage management. She is nothing but a puppet of the moneyed interests. They gave her a few million by publishing her so-called book and now she is going to snowplow Johnston just like she did every other opponent in her past. It might actually work on Johnston because after all he is just a kid.

    One hopes of course, one day, she will be called to account for her misdeeds by an ediface she cannot cow or outspend.

    One need only refer back to Palin’s Ethics Violations during the Troopergate case to know that she will stop at nothing to get her way. She didn’t back off even after being warned by another judge. The judges in the custody case must be well aware of her vindictive nature — they already did the right thing by keeping the proceedings open to the public.

    This will bite her in the butt. She’s not even supposed to be involved — and here, she’s calling for actions against the judges. I hope they throw the book at her.     AFIK, Father’s Rights are pretty high up in the conservative agenda. Of course, child custody conflicts and issues are hurtful regardless of one’s interest in politics, but my observation has been that the politcal/social movement is grounded in the GOP/Teabagger corner. Wasn’t WAR- the Ross AG nominee a big Father’s rights advocate, correct? Weren’t one of the groups displaying materials at the Wasilla book signing focused on this issue as well?

    It seems to me that SP is not ‘walking the walk’ for parental rights in her own family. [Also, perhaps she has missed any and all references to the power of forgiveness in her Bible and church attendance. but that's a whole 'nother story.]

    Personally, I don’t even understand why Bristol Palin filed for full custody – even a layperson knows that parents will get some sort of joint custody unless there is very clear evidence of abuse and probable harm. Watching 2008 Sarah Palin in action during the presidential campaign, I am not least bit surprised. And as researched, what she said was fact checked and I discovered not true almost all of the time.

    Sarah Palin presently does more than likely have backing of some US rich Republicans. Planning for 2012 is already underway. Book tour, speaking engagements, visiting some states, etc. Political strategy was more than likely sole reason for resignation from being governor.

    Shockingly now – she has her followers harrassing Alaskan judges for her. Harrassing judges is quite dangerous. Can become quite dangerous. I feel if she does nothing to quiet her followers, by all appearances she is most certainly approving their actions. Political strategy at play once again. Strategy for combating open to public trial.

    I hope the courts stand firm, I hope the FBI hauls the instigators into custody and carrys out an extensive investigation. I hope any who show up to protest are arrested. I hope that when the arrested try to find lawyers to help them out, none will agree to represent them. For God’s sake, a court house in Vegas was shot up yesterday, one law enforcement officer was killed!

    If I were making a decision on custody, I would be very fearful that the Palin home is unsafe. The individuals devoted to SP are threatening, appear cult like and the smell of danger abounds. It seems readily recognizable that SP is inciting the unbalanced worshippers and when they get wound up to a frenzy, she does not wisely use her influence over them to slow and calm them.

    How come Granny Palin always thinks that everything is all about her? The custody battle has to do with Levi, Bristol and the Trapp – no one else – and, especially not Granny Palin. I hope Levi is sitting back, being quiet and allowing Granny Palin and her crazies continue to dig the Palin hole deeper and deeper. The “Palin Plan” to harass the judges is helping Levi more than it is detrimental. If Granny doesn’t have anything to hide, then why would she want the proceedings closed, a proceedings that she is not even a party to. If the proceedings is closed, then Levi doesn’t stand a chance at having a fair hearing. Also, closed proceedings have the appearance that something shameful has happened that the parties don’t want the public to know about, which gives Granny Palin the usual appearance of being suspicious of doing something wrong.

    Levi – put your feet up, keep your mouth shut, sit back and enjoy the show – these people are helping your case more than they are hurting your case. And the nice part is, I am sure some of the crazies are going to screw up and threaten one of the targeted judges, and Wooten and other law enforcement will be close by to arrest their asses and throw them in jail – harassing a judge is no laughing matter.

    Let’s see if Beehive Jessie likes getting a bee up her skirt as she’s sitting in a jail cell, with Eddie Burke tagging along.

The best interest of the child demand that the proceedings be secreted. It might work. Ironically, what the facts honestly show is that Rex proved the vindictiveness of Sarah Palin.

    It’s funny because I was sure Bristol’s attorneys dropped the ball in such a brazenly incompetent fashion because they secretly wanted the proceedings open. Other than a pathological need for attention on the part of all Palins, I’m not sure what the lawyer’s malpractice proved. Maybe he is just a joke of an attorney, sometimes a cigar……

Help them learn to earn the things they want so they don’t grow to think they are entitled. Set boundaries so they know they are safe and secure. Say No. It’s the hardest word a parent can say to their children sometimes but say it anyway. They’ll “hate” you for a little while, but after it all they’ll respect you for it. Understand you are not your child’s FRIEND. Your job is to parent, to teach, to guide and protect. They have friends for friendship.

    Actually the post is still up on Sarah’s FB page. It has been reported several times and yet it remains there for anyone to find if they look for it. I think that since we know how quickly offensive posts are removed from her page, it is not unreasonable to state the page is heavily moderated. If you post something that Sarah or her fans find offensive, you are deleted and banned quite quickly, so the fact that this post remains indicates that not only does Sarah support it (it is her page after all), her fans support it as well.

I wonder what would have happened if she had NOT given in to her greedy self and said NO to McCain? Would these two kids have gone off, had a small private wedding, and began raising a family? She threw her whole family and now her grandchild under a bus with both hands and is complaining because judges won’t ‘treat her right”? Threatening judges while HIDING behind somebody else? Business as usual. I do believe Sarah Palin is a true zealot in that SHE believes what she says and is COMMITTED TO her stand, when she should just BE COMMITTED to an asylum. Unfortunately, there are those who believe anything a zealot says if its said with enough passion – I hope their number is dwindling.

    Anti-Palin rally organizers receive threats

    Opponents of Gov. Sarah Palin’s policies are being threatened.

    Alaska Women Reject Palin, a local group that opposes the Republican vice presidential candidate, on Wednesday announced plans to host an anti-Palin rally this weekend.

    Since that announcement organizers say they’ve received intimidating messages.

    A press release for the Reject Palin rally went out to practically every media outlet in town Wednesday. And one talk radio host decided to share the names and phones numbers of the two contacts on-air.

    That decision has left organizers feeling somewhat fearful of practicing their First Amendment rights.

    KBYR talk radio host Eddie Burke admits he is a conservative and a “Palinista.”

    But on Wednesday Burke resorted to name calling when he found out Alaska Women Reject Palin planned to host a Saturday rally.

    “They’re a bunch of socialist maggots, that’s what I’m going to call them — socialist maggots, that’s what they are, a bunch of socialist baby-killing maggots,” said Burke.

    On Thursday Burke pulled back, a little.

    “Yesterday, I was probably a little over the top,” he said.

    The talk show host encouraged listeners to call the two women listed on the press release, which he calls a public document.

    The new Facebook group’s statement bears a remarkable resemblance to Sarah Palin’s writing style – problems with capitalization (totally random) and punctuation (not understanding the difference between plural and possessive – “beluga’s” instead of “belugas,” for example.
    More disturbing is the Palin thinking that the decision is the “worst in Alaskan [make that Alaska's] History [another problematic capitalization]” – it points to her narcissistic disorder – thinking a very pedestrian custody case and a ruling that says it will be treated as any other custody case is more important to Alaska than any other ruling in the state’s history?
    Most disturbing is knowing that the Palin family is whipping up a mob to threaten judges, showing reckless disregard for the judges’ safety. Like their response to Wooten, the Palin’s thirst for revenge is frightening.
