Open Thread – Baldy and the Swamp

We’ve had a good solid four months of winter now.  And thanks to the marmots who apparently hibernated right through Alaska’s official “Marmot Day” on February 2nd, the news is not good. Sleeping right through the designated shadow analysis period,  it appears as though the marmots have assured us a few more months.

So, it becomes necessary for Alaskans to find ways to cope, which for me usually means that I think of the other half of the year, when there are things like chlorophyll and birds.  I find myself daydreaming and planning for all the things I’ll do when summer comes. It almost doesn’t matter if I really think I’ll do them or not.  It’s just nice to dream.  That plus red wine, chocolate and an X-tra large steaming bowl full of denial gets me through.

The picture above was taken in Trapper Creek, Alaska – a couple hours north of Anchorage.  This was a nice day to think about.  The flat area with the grass is known to the residents of the immediate area as “the swamp.”  Not particularly romantic, but descriptive nonetheless.  The mountain in the background is known as “Baldy.”  You would never imagine that a scene that could be entitled “Baldy and the Swamp” could be so lovely.

If you don’t mind, I’m going to go hang out on a reclining deck chair and catch a few rays… just as soon as I get some lemonade.  You’re welcome to join me.

    I’m on the deck with you AKM . . . sun rays warming our eyes that are peeking through our balaclavas, and our jackets and overalls are getting less frozen and stiff. I think, though, I’ll stick to the hot chocolate instead of the iced lemonade. I’m just glad that I’m not in the mid Atlantic.

    Congrats of breaking the tax cheat story. You Rule!

    hi folks. After the tax story, and the tax cap… I’m wondering how much the Palins pay for property tax on their places on Lake Lucille. We have a cabin on a lake in Meadow Lakes Ak where the property tax went from 1300.00 per year in the late 90′s to 4,000.00 per year in 2010. (How much did it go up due to mayor palins running up the bills… even though we are residents of the mat su borough).

    In addition to all the free labor and materials from SBS (im sure this is true:)
    did she put a tax cap on her Lake Lucille houses? Can we do a review of laws she made where she benefits?

    I like this part of the AP story “Palin’s attorney, Thomas Van Flein, says it is not the responsibility of property owners to report structures that go up on their land. ” Go up? Magically appear? Gosh, I didn’t notice that some structures “went up” on my land.

    Does anybody know what a scofflaw is? I’ve heard of them. Let’s take her advice re: Rahm Emmanuel and reduce government by removing awl of her “appointtees” since she willfully broke her oath to serve thus invalidating the state’s need to keep it’s end of the bargain. Can’t help it. She broke the contract unilaterally also too. Furthermore, let’s hold the ameliorating, necessary vote for governor immediately. We don’t have to wait around to be polite.

    It may actually be that it is the property owner’s responsibility to report new structures – but I don’t see how that gets Palin off the hook.

    Look at it this way: I am responsible for paying my income taxes. I once did some moonlighting for a small business that failed to report my pay to the government – but it was still *my responsibility* to report that income when I filed my return and I was still liable for paying income tax for those earning even though I hadn’t been “caught” by the authorities.

    If I had not paid those taxes, and later were found out, I would not in any way have been off the hook just because I had gotten away with it for a couple of years because the IRS had not audited me.

    Lots of misinformation running around on the MSNBC ‘Cabingate’ thread and the mindless comparisons to some others re: taxes is staggering: each situation is a separate issue and are not comparable a la apples and carrots. I don’t have the time to fight the stoopid, unfortunately.

    I don’t know if I left this on another thread here or somewhere else, but I think technically Van Flein’s statement is true: property owners do not have a responsibility to report the structures that ‘magically appear’ on their property.

    But they do have the responsibility to report the VALUE of those structures. Cleaver, really, but that’s what lawyers do.

    Anyhow, I think his and Meg’s statements take the wind out of the sails of any future trying to blame the whole thing on Scott Richter. We don’t know what arrangement they have with Mr. Richter, other than he takes care of the paperwork, apparently. The only way they can claim ignorance is if the agreement was that Richter was to be responsible for ALL taxes.

    If that is the truth, why didn’t Van Flein say “The Palin’s agreement with Mr. Richter is that he was to pay 100% of all property taxes owed and as such the Palin’s were not aware of this oversight. They will be contacting him immediately to get the matter resolved.” or something like that. But no.

    If taxes were split in any other way, I find it very hard to believe that the Palin’s never saw a copy of the tax bill that clearly showed a value of $0.00 for the structures they knew full well were there and valuable in 2007, 2008, and 2009. Scott may have done the reporting, but as co-owners, the Palin’s had equal responsibility to correct the error.

    Again, have Van Flein or Meg Stapleton explained anything like this to us? No. And it’s too late now. If they try now, we will know for certain it is a lie.

    17.02.020LAND USE PERMIT.

    (A)The land owner or authorized agent shall obtain a land use permit from the Matanuska-Susitna Borough Planning Department prior to the commencement of construction.

    (1)the construction or placement of any building whose gross floor area is 480 square feet or greater;

    (2)any addition exceeding 10 percent of a building’s gross floor area and that results in a total gross floor area of 480 square feet or greater;

    (3)an increase in the number of dwelling units within those areas of the borough with land use regulations addressing the number of dwelling units;

    (B)Permitted construction activities shall commence within three years from the date of issuance of the permit. The applicant may request that the planning and land use director approve up to two 12-month time extensions.

    (C)The planning and land use director may administratively grant minor modifications to an approved permit as long as the proposed modification complies with all code standards. Minor modifications shall consist of no more than a five percent change in gross floor area or a change of less than 10 linear feet in the placement of a building. The applicant shall submit an updated site plan and a narrative description of the proposed modification for the planning director’s review. No fee is required for the submission of a request for a minor modification to an approved permit.

    Required by law. And I think we can assume this person is a credible source.

    Who embarks on *any* construction project like this without thinking about how it’s going to affect their taxes? And it’s not like their co-owner put up a storage shed and didn’t tell them – these are *houses* – and Sarah has volunteered that she has been there and stayed in them.

    It’s been noted before that the Big Lake address for Richter Investments is the same one used by the Alaska Inaugural Committee. I was really curious about this and came across a recent report by the Center for Governmental Studies that describes how politicians use loopholes to evade campaign finance laws, where contributions are limited. Low and behold, one of the examples cited is the Alaska Inaugural Committee (I’ve also posted this in Palingates as junasie14):

    “In Alaska, post-election donations to Governor Palin’s inaugural committee came from four mining companies, including Northern Dynasty, a co-developer seeking to influence Palin to speak out against a state-wide measure that would have imposed costly environmental regulations on mining operations. The mining interests did not play a major fundraising role in the 2006 gubernatorial campaign. Alaska Inaugural Committee, Inc., the nonprofit corporation that raised funds for the events surrounding the inauguration, was not required to publicly disclose the amounts donated to it for inaugural balls and travel for the governor and her family.”

    So this committee took in political donations which did not have to be disclosed, and their website directed all correspondence and donations to the same PO box in Big lake being used by Richter Investments (http://www.alaskainauguralcommittee.org/contact...). The site shows Debbie Richter as the Committee (and campaign) treasurer, and states that “any net proceeds will be donated to charities of the Governor’s choosing. None of the proceeds will be used to support any political party, candidate or for any other political or lobbying purpose.”

    Ha! The study quoted above found that post-election donations were specifically made for lobbying purposes. And Sarah’s favorite charities are what again? Oh that’s right, there is no need for disclosure. Conflict of interest would appear to be an understatement here.

    This certainly begs the question of what the relationship was between Richter Investments, this non-profit money machine, and some lovely vacation properties, not to mention one very busy post office box. Can $arah’s web be any more tangled?

    Good morning AKM and puppies. Would be pleased to join you on the veranda having a tangy glass of lemonade with a sprig of mint from the garden while enjoying the gorgeous view.

    Am gearing up for the impending snowstorm due to hit us later this afternoon. Predictions are for up to six inches with high winds. I have tickets to a concert I’ve been wanting to see for weeks and it looks as if I may miss it. Sigh.

    My wonderful neighbor is excited because he will have the chance to use his brandy-spankin new snowblower to clear the sidewalks in the neighborhood. I appreciate his help more than I can say since my home is a large corner property (yes all our assessed taxes are up to date and correct including all structures thereon – LOL)

    What a very satisfying turn of events lately – no?

    I was sooooo pi**ed at the media yesterday for not crediting AKM with breaking this story. I went on every website I could to make sure they understood that she was the one who got the information and did the research and posted the blog that started it all and linked to Mudflats. I see, this morning, that she is finally get her richly deserved acknowledgment in the media! Fair is fair.

    Someone commented over at Palin’s Questions (http://palinquestions.blogspot.com/) that other property owners are going to be angry because they may have added “cabins” without reporting them, and I replied that I question his attitude that laws only apply to those who choose to obey them? I believe that this is the crux of this matter.

    I think this story has broader implications than what we see at the moment. The documented fact that she called someone else’s integrity into question over the precise thing she is a party to is utter and blatant hypocrisy. It is just jaw-dropping, mind-boggling mandation!

    Read it and rejoice. It think this gives a lot of strength to Andree McLeod’s case. I wonder if the Alaska Constitution has a statute on “private citizen unpaid advisors” in the ethics section.

    Also there is some hanky-panky about financial disclosures from Tahd’s work email account at BP to his personal email and thence to the gov’t
    email. That looks very damaging.

    The Alaskan laws appear to be unavailable to be applied in any instance with this former regime and its continuing holdovers. More’s the pity. We have a constitution; we are a duly constituted state fifty years old for crying outloud. In fact, we are crying out loud in the wilderness. Federal government do you hear us?     Ha! Trapper Creek! I came up from Massachusetts last summer, rented an RV, picked up my grandkids in Anchorage and headed out for … Trapper Creek! Stayed overnight in the campground there. Very nice place. Strolled around the next morning; guess we must have walked in or viewed the swamp. Drove over to Talkeetna for lunch (a *great lunch, by the way). Felt like we were in McKinleyville, CA – very laid back. Thanks for the reminder of that great trip!

    Todd was a private citizen and held NO position in the government, nor was he elected “by the people” to be privy to confidential information. How was any of his involement (making policy decisions, sitting in on meetings, getting confidential emails,etc) legal? He held NO public position.

    It also said that he passed confidential information from his employer to influence decisions.

    There is NO reason that ANY of his emails/comments,etc be redacted. NO REASON. He was a private citizen , and if he could see them….every private citizen should have the SAME rights as Todd Palin. Not allowing others to see them is setting up the Palin’s as “elitists” with special rights not available to “real American’s”.

    I think a lot of heads should role with this information. Not only is it bad for Sarah and Todd, but what about others in goverment who included him in emails and decisions without taking a stand?

    To me, these prove she unethical and a weak leader….she needs hubby to help her do her job. Another black eye to the women’s movement….she needs a man to help her do her job. Sad….very sad.

    As for the Todd e-mail scandal, think of this. Todd was pulling all these shenanigans while still a member of AIP, which could be considered Alaska’s Tea Bag Party. He only dropped his membership when Sarah got the VP nod. Tea Baggers will still back them, but fortunately they are a crazy minority and most Americans in the middle will now get a good look at the Palins and turn away from her in my opinion.

    I only hope when all is said and done, Todd and Sarah have done jail time and lost every penny of their new found riches and fancy homes and are sharing a cell with Vic Kohring at the prison in Taft, California.     Judge McKay, whose decision you are referring to, is not on the Alaskan Supreme Court. Andree McLeod has filed a Reconsideration motion with McKay. If he refuses to change his decision, then it may be reviewed by the Alaskan Supreme Court. See AKM’s most recent post on “Dude, Who’s My Governor?” Near the bottom of that post, she has a link for the Reconsideration motion.
