Shoveling Through Kristan Cole’s Press Release…

Boots?  Check.

Shovel?  Check.

Aspirin?  Check.

Flask?  Check.

OK, looks like we’re ready to go on a field trip, and shovel our way through yesterday’s press release from Kristan Cole, trustee for The Alaska Fund Trust (aka Sarah Palin’s legal defense fund).  Stick with me and don’t get separated, or we may never find you in there.  It’s easy to get lost in the histrionics, the whining, and the unrelenting spin.  Ready?

First off, we learn that the conclusions reached by Mr. Daniel are “unprecedented in the history of our country.”  Yes, never in 223 years and two weeks has there been such an outrage!

On a side note, I envision the beleaguered Mr. Daniel at home with a nice big snifter of brandy, muttering and throwing those fancy expensive darts that come in a wooden box at a target featuring the official state portrait of the soon-to-be-ex-governor.  We’ll call this the “Branchflower Syndrome.”  This happens when a respected independent investigator gets thrown under the bus because he came up with a conclusion that Palin didn’t like.

Back to Cole’s press release, and a few discrepencies we find contained therein:

1.  Final?

From Cole:  Because [Daniel’s] initial review was unprecedented and contained factual errors it was my understanding that Governor Palin’s legal team, including Mr. Van Flein, were in ongoing discussions with Mr. Daniel.  The matter was not final.

And this, from NPR

But Daniel said his report was final.

2.  Who decided?

From Cole:  This is particularly notable, and concerning, in light of the fact that the Trust, on my instructions, has not paid even one penny to Gov. Palin or her lawyers. I issued that instruction because I was aware the Board was reviewing this matter.

And this from Tom Daniel’s recommendation:

My recommendation is that the governor should refuse to accept payment of her legal fees and costs from The Alaska Fund Trust and withdraw her authorization for the trust to be recognized as her “official” legal defense fund.

3.   Silliness

From Cole:  So far Mr. Daniel is the only lawyer in the country who has questioned a legal defense fund. (!)

4.  Involvement

From Cole:  I want to be clear on a point that has been misrepresented: The Governor is not and was not involved with the Trust. The Governor has never worked on or with the Trust.

5.  Asking for help

From Cole:  In their own humble way, the Palins never asked for help.  The Governor never asked anyone to help with this legal expense fund.

From Sarah Palin:

Obviously we cannot afford to personally pay these bills — and really no future governor should feel the sense of financial vulnerability at the hands of those with a political vendetta bent on personal destruction,” Palin wrote. “Some have suggested a legal fund to pay these bills. We’ll have to pursue that.”

“I must defend against these baseless ethics accusations out of my own pocket as the use of public monies to do so could itself violate state law,” Palin wrote.

“As governor of the state of Alaska I have accrued bills for legal representation concerning false, wasteful and frivilous (sic) allegations,” she wrote in her March statement. “To defend my actions as Governor my family has amassed hundreds of thousands of dollars in fees.”

She also mentioned it in her speech at the Anchroage Lincoln Day dinner.

If you say “I’m thirsty!” enough, someone will usually offer you a drink without you having to say “I’d like a drink.”

(I look over at you and notice that you’re leaning on your shovel handle, and looking a little pale and sweaty)

I think it’s time for a break.  Everyone have a seat for a minute.  Pull out your aspirin or flask, or some hydrading liquid and we’ll pick up again in a little while…

    “The first and only time I have spoken with the Governor about the Trust was yesterday to alert her that I was responding to this violation of the law and leak of preliminary and confidential materials from the complainant.”

    If Kristan Cole never spoke to $arah Palin about the Trust until yesterday, how did the governor obtain the names and addresses of donors so she could send them handwritten thank you notes?

    Did somebody leak this information to $arah behind Kristan’s back???

    As there were no disbursements from the fund whatsoever, did the governor pay for the cards, envelopes and postage out of her own pocket? (ha ha ha ha ha ha ha)

    Navy veteran and Alaska citizen Mark Bowers (follow Mark on Twitter) received a pleasant surprise after he donated to the Alaska Fund Trust to preserve the integrity of the Governor’s Office of the State of Alaska. His donation helps to cover the legal expenses of defending against the frivolous complaints filed against Governor Sarah Palin. She surprised him with a personally written thank you note from the governor herself.

    The report says otherwise, states it as fact and the information came from…..Cole!……….and the website.

    And Cole is accusing Daniel of lying AGAIN!

    This part of the report gives Palin no wiggle room whatsoever, it is as clear as crystal AND final.

    According to the funds website, it was created by Kristen Cole and other supporters of the governor who believe the governor should not have to personally pay for legal fees incurred in defending against a series of ethics complaints.

    I interviewed Ms.Cole, who confirmed that she and other supporters of the governor came up with the idea of soliciting contributions to pay the governors legal fees.Ms.Cole also stated that she and other supporters set up the Alaska Fund Trust.

    She also stated however, that THE GOVERNOR GAVE HER APPROVAL TO CREATE THE TRUST as the “OFFICIAL LEGAL DEFENSE FUND for the governor and AUTHORIZED THE USE OF HER PHOTOGRAPH ON THE TRUST’S WEBSITE.

I was in journalism school during Watergate, and my News Editing prof, a former Wall Street Journal editor, kept telling us, “keep looking at WHY it’s happening, not just WHAT.” It was a real-time lesson in the quirks, strange turns and march of history. Looking back, quite a lesson.

    I think Daniel did what he felt was right under the current constraints of Alaska law — which are crap. The guy seems to be an honest attorney, looking at the law (crap) and interpreting it as he sees it. He made recommendations based upon CURRENT law, and perhaps that is all he could possibly do. Sad, yes … but honest, I think.

    “This whole debacle would have been swept under the rug if the report had not been leaked. I personally think it’s time for the courts….and putting these people under oath. I’m sick and tired of the lies and spins.”

    It’s unfortunate that it takes a leak to get the truth out. But if that’s the only thing that will do it, more power to it! Yes, “under oath” would be the far most preferable way.

    In fact another date I’d read is set for the 26th..
    Is she trying to beocme private citizen to try to do an endaround the lawyers /Boards request for her not to touch that money while she is still Gov.
    Private citizen–THAAAt’s another matter now huh…court dat re emails too coincidental.
    The judge in case made sure the emails got preserved–but she very badly does NOT want those emails out…and they already show she was conducting state biz on her private acc…

    The ethics costs were $296,000, $187,000 of which was for Troopergate which is the complaint Palin filed against herself.

There is a whole lot that we don’t know yet, but with this incredible group of sleuths working on the investigation, I’ll bet we’ll get to the bottom of these secret evil dealings. I seem to recall she stated at some time that she nor Palin had nothing to do with that group, and were not associated with them. I wish I could remember where, maybe the ADN.

    So, if so, why would SP not want to be affiliated publicly with that group? There are so many holes in this scenario. And the RAM knowing John Ziegler. Hmmmm……is right!

    My curiosity is tweaked and my mind keeps coming back to Kristan Cole operating and controlling the Legal Fund Trust that she supposedly decides how, when, why, where and whom every cent is dispersed and her statement not a dime has been paid out. Would that be because of communication between Cole & Palin to wait until Palin quits? Palin mentioned it’s been in the works for a while. To disperse it after she is out of office believing it then to fly under the radar as no more State Ethics to follow???? Why Cole has always remained in my mind throughout this whole Legal Fund:

    Kristan Cole is knowledgeable with trust accounts as they relate to real estate because of the real estate business she owns and therefore knows the rules, regulations, laws and operation of same. This agency if I recall correctly, was once her mother’s agency.

    She is also knowledgeable that:
    “Early in 2002, B.C. broker Cheryl King shocked the local real estate community and the 35 sales reps at her Re/Max Assist Realty office in Kamloops when she disappeared, along with trust fund money and real estate commissions.

    She faced charges of fraud, breach of trust and forgery, but it took until last month before the issue was resolved. King, now known as Cheryl Moseley, pleaded guilty to one charge of illegally accessing trust funds on June 21, reports The Daily News in Kamloops.” (from blowpoppalin.blogspot.com/2009/06/kristan-cole.html)

    Under the category of “you can’t make this stuff up”, Cole’s mother, Cheryl Moseley King has a colorful past involving…(wait for it)….trust fund money. We can only hope that Cole did not inherit her philosophy of money management. (themudflats.net/2009/04/24/alaska-fund-trust-its-the-new-sarahpac)

    It raises questions in my mind as she has knowledge because of being a real estate agency owner whereby a trust account is standard in order to operate business. The Legal Fund Trust would have some similarities in operation and therefore ought to make it easier for her to understand the workings of it (but am I giving her too much credibility in understanding trusts– possibly). It also raises the questions in my mind as to what conversations were there between a Mother and Daughter, both of whom are/were real estate agents/owners as to the legal charges and what may have transpired to get to the point of charges — in those conversations answering the questions of said charges as the legal proceedings went on for a long time so I would think it hard to say they never discussed it. Questions that make you go hmmmmm.

    Having worked with numerous trust accounts and the rules, laws and regulations to operate same, and having read the many articles and documentation regarding Kristan Cole with respect to the issues of the various positions she has held within the State with regard to the dairy and all the others set out for everyone to read and with regards to monetary issues and problems and then add in Palin with their longtime friendship, business dealings, appointments of Cole to state positions and just the way Palin has carried on in her positions of appointments and elected positions. You could add in the other surrounding players like Meg who has held numerous positions under Palin including on the National Campaign, SarahPac, family spokesperson (she responds as to Levi), media spokesperson, etc. The communication between CeePees and the Fund may have been with Cole and/or Stapleton for the beg-a-thon. The CeePees obtaining of info that has been on the site but didn’t seem to be available elsewhere would be possibly Stapleton on behalf of Palin. Any communication with Stapleton I would consider it as coming from Palin as that would be her spokesperson.

    There are too many spiders working in the same web raising even more questions on the Hmmmm radar.

    You know, something is really off with this whole Daniel finds a problem this time and it’s in the open, supposedly because of a leak from the Board itself.

    I have to wonder…how many other Daniel reports did find a probable cause, but the Board refused to proceed further by ‘dismissing’ the charges?

    So, my questions to everyone are:

    1. Have any of the other investigator’s reports been released?
    2. Is there a mechanism in place for investigator’s reports to be requested by some type of citizen’s request?

    I seem to remember that somewhere around here, if not other AK based blogs, that there have been discussions over whether the ‘public’ could request information on closed cases. So if the answer to #2 is a “yea”, I’m up for contributing towards the inevitable high cost of securing those reports. Just spread the word on where to send the $$.

    Oh, yeah, winkwink, I was going to remark on the other idea you had — throwing Monopoly money at Palin a la ARod — that made me laugh…I’m not as much a Mariner fan as I was years ago, and not as much as I should be, I suppose — but I followed the whole ARod saga from his last year in Seattle through his free agent campaign to collect as much money as he could — and I was watching the first game he played at Safeco after signing with Texas.

    I got “into it” with a lot of Texas Rangers fans and later, a lot of NY Yankee fans about how I felt about ARod — my opinion hasn’t changed, either before or after his not-very-believable Sarah-Palin-like “confession” of steroid use for one year as a Texas Ranger after reports this last off-season showed he’d tested positive.

    So I know exactly what you’re saying about the similarity in the situations.

    The $500K isn’t even remotely related to the ethics complaints costs. The 13 ethics complaints costs reported by Palin’s Personnel Board for the cases decided before June 30, 2009 — not counting the 3 complaints in the Troopergate case which include the self-filed Palin complaint — amount to $108,244.96.

    The 3 in the Troopergate case amount to $187,797.62 (for a grand total of $296,042.58).

    So, the $500K is obviously something else entirely. I believe one theory was that the $500K is what it cost to have the McCain campaign operatives (the ones Palin has been implying to the outside world were Democratic operatives) clean up her family’s Internet activities including too-revealing pictures of her and her family and information on Palin and Johnston computers, and hinting to people “in the know” not to talk… Evidently the RNC didn’t want to pay that bill, so it got sent to Palin. Oops.

    And all the examples he gave were for federal employees – including Ted Stevens. So he’s from AK, he isn’t a State of AK employee, the AK ethics act didn’t apply. The distinction isn’t rocket science.

    This is on par with the tax advice Sarah got. Per Diem not taxable in AK, so her tax person didn’t include as taxable income for federal. Wrong.

    Right. In order to put together a report like that you start working on it on … July 13th… 12th… 11th?

    My jaw drops when I read statements like that, given as irrevocable proof of the fact that Palin’s resignation had absolutely nothing to do with any pesky reports.

    She wouldn’t need a legal defense fund to pay bills if A. she was ethical or B. she didn’t hire a personal attorney. Of course, if she used the state’s attorney then her records would be open and transparent.

    Horrors.

    One has to wonder what she is hiding. And I hope it’s worth it to her. (and you know we’ll find out anyway.)

    There is something about the combination of politics and truth that is like oil and water. They just don’t get along. I am reminded of how the Swift Boaters told lie after lie about Kerry, and developed quite a following.     i think the problem with Sarah letting the state pay for the frivolous ethics part of her bill, is that she can’t itemize that $500k as ethics complaint bills. The ethics complaints filed against her (not the one she filed against herself) are probably only a small portion of that $500k, the rest of her legal bills are for her private attorney, which I don’t think the state will pay.
    She can’t let her supporters know the amount for the complaints was not $500k, that’s the total she keep saying was bankrupting her and they were sending money, without questioning anything she said.
    The people going to the picnic should throw (monopoly money, a la A Rod when he came back to play at Safco Field) at her when she has her little I’m leaving speech. LOVE TO SEE THAT!!!!all that fake money flying in the air around her…

    This is EXACTLY what they all do – it’s part of their strategy. Picture the truth as sunshine, and the Palin Players as Vampires. Do they want the light? Of course not! They do not care about the truth – because they plan to bury it or confuse the issue so thoroughly that the only thing one of their dimwitted followers remembers is the rebuttal full of blame on someone else.

    Think about her followers (I know it’s hard) – I recently ran into one that I spent over a week giving all ALASKAN points of view from blogs, commentary and reporting. This person is not the typical stupid bot, I’d say he was a thinking bot. He discussed many other political items and agenda with knowledge, research and a sort of open mind. But the Palin stuff? Even though I used NO MSM articles except maybe one to describe the poor performance of Meg Unstapled, this thinking bot did not change his mind. He still thinks she’s a victim of the liberal media and was given a bad rap. Not once did he acknowledge that awakened Alaskans, the ones who have put up with her crap and are now saying “hit her in the butt” to the door, were jaded and sick of her. Not once. I don’t think he could even think it in his brain. Did not compute!

    So even in thinking conservatives (who can also spell – hallelujah!) , there is a brain fog because they are so desperate for a candidate who can bring them out of banishment. They are lost, they aren’t listened to, the way they get more followers is to breed rather than teach and convert. They do NOT look at the facts.

    This bunch, the Palin Grifter Gang, counts on this. That’s why their spin stories give us a headache – you think “What? Why would they say that when they are on video saying the exact opposite (or whatever)?” They aren’t logical – they play on emotions – it’s their only power. They employ the emotion du jour as they see fit.

    From my view, this is the Teflon we speak of so often. It doesn’t work with intelligent, curious people because once they question, dig a bit, or are presented with overwhelming information, they actually make a decision. But it works in two other ways – it works with the Palin brain-deads, and it works with the MSM media because they miss so much information because they go to the screaming one first, and forget the back up info. And so that’s what people read, and remember. It’s why so many of us mourn real investigative journalism, which follows a story in detail with as much relevant information as possible presented. This may take weeks, months, years! And so much of the country doesn’t have that type of attention span anymore.

    If anyone has taken the 40 hour First Aid training, you should have been instructed to not “focus on the blood” as a first responder. Blood usually makes a wound look a lot worse than it is, and often their are other injuries that are “quiet” but much more serious. We are drawn to the sight of blood in an emergency, and unless trained otherwise, might make serious mistakes by not checking out the whole body and looking for internal damage as well.

    This is the MSM. They didn’t take that course! Rant for the day!

    1) Palin authorized the fund as her “official fund” and allowed her photo and name used.

    2) Palin required that the fund be totally “Alaskan” in its genesis and operations.

    3) Palin has a link on her own “SarahPac” to the Fund Trust.

    4) I found several sources which state that the governor had certain parameters imposed on the Trust’s structure. One source is the WSJ link below. Note the sentence in bold.

    Mr. Daniel’s interpretation of Alaskan law was accurate….although he did show quite an unprofessional bias of verbalized sympathy in his role as an independent investigator in a legal report.

    This whole debacle would have been swept under the rug if the report had not been leaked. I personally think it’s time for the courts….and putting these people under oath. I’m sick and tired of the lies and spins.

    Curious to learn more about Kristan Cole or Kristan Tanner – I searched for any info on her claimed Miss Alaska and Mrs Alaska experiences. According to her own real estate site, she was Miss Alaska in 1982.

    Sarah Palin attempted the pagent in 1984.

    The only listing I have been able to find identifies another person as the winner in 1982. Hmmm….just curious. The identity of the ’82 winner was Toni McFadden. There has never been a Miss Alaska with a first name of Kristen or Krissy or any other permutation. I have not been able to find any listing for Mrs Alaska historical winners.

    Just another amusing discrepancy, perhaps there is a reasonable explanation or others can be more effective sleuths on this entertaining matter. I have strong feelings on the value of beauty pagents, and it surprises me not in the least that these two gals were on that circuit as young women.

    According to Celtic Diva, this is as final as it is probably going to get. Unless the board Does decide to meet and issue a verdict, however, he was trying to prevent it from going that far with his recommendation that she not take the money.
    According to Diva, she isn’t suppose to touch the money for 2 years, but that is when she was Governor, I don’t know how that holds now she has quit. I think Palin is under the impression that if she is no longer Governor she can take the money and fully intends to do so.
    I think JHop has some issue with that, but will the law stop Palin, it never has, and probably not now either.
