Ethics Complaint #18 Filed Against Sarah Palin

Anchorage resident and registered Republican Andrée McLeod has filed an ethics complaint today with the Attorney General’s Office charging that Governor Palin violated the Alaska Executive Branch Ethics Act and knowingly, intentionally and willfully abused her official position and state resources for partisan political purposes and withheld official action for personal and political interests.

“We’ve been had,” says Andrée McLeod. “Sarah Palin failed to preserve, protect and safeguard the office of the governor for selfish reasons and the State of Alaska and Alaskans were left vulnerable and exposed.”

Signed and completed official travel documents show that upon being summoned by the McCain campaign on August 27th Sarah Palin wrote “Conclusion of state business” for that day and flew off to places unknown. After her failed bid, similar documents state “Return to duty status”. However, payroll documents show Palin continued to receive her $125,000 governor’s salary and benefited by using state funded staff on the campaign for ‘state business’ while knowing she was off duty.

“By signing these documents Sarah Palin knew she temporarily quit as governor to campaign for VP full-time; but by pocketing her salary Palin deceivingly used her official position and state staff for partisan political purposes to garner votes.”

The complaint also touches on the Alaska Constitution’s Article 3, Section 9: Acting Governor ~ In case of the temporary absence of the governor from office, the lieutenant governor shall serve as acting governor.

McLeod asks, “What was Sarah Palin thinking when she went off to the Lower 48 for God knows how long without transferring duties to the lieutenant governor? Alaskans were left fending for themselves while Outside political campaign operatives hijacked our system of governance and rendered it paralyzed. Who was looking out for Alaskans and where was the lieutenant governor? How could Sarah Palin be so thoughtless?”

    I sure hope those in Alaska are and will call for a complete state audit of the books, including all personel under Palins friends umbrella. Did Todd collect a paycheck while being her official, unofficial shadow government while doing her bidding for her on state time and dime?

    Complete audit needs to be done.

But then she suddenly had a huge, and very public, problem when the news leaked that during his workday Ruedrich had been using his office computer to conduct Alaska Republican Party business.”

    “And then in a public fit of professed pique, in January 2004 she quit the Commission because, since the Attorney General’s investigation of Ruedrich’s violation of the Alaska Ethics Act was ongoing, she was precluded from publicly discussing what she knew about it. As Sarah went out of her way to tell the Anchorage Daily News, the state’s largest newspaper: “I’m forced to withhold information from Alaskans, and that goes against what I believe in as a public servant.”

    Palin’s office says the state personnel board rejected the complaint — alleging Palin has been paid for media interviews — in part because it was not properly notarized.

    The governor’s office says a board official also noted the panel already has determined that media interviews did not violate ethics law.

    Palin representatives say the governor has not been paid for media interviews and the complainant, Raymond Alvin Ward, lacked evidence to back his contention.

    The complaint is among 18 ethics grievances filed against Palin, most of which have been dismissed.

    Once her resignation is official, the ethics complaints will become moot and will not even be investigated. If the goal is to punish her and/or get back the wasted money, then these complaints should be filed as law suits. Otherwise, what is the point? The only good I can see coming from this is if the complaints are investigated (unlikely) and if she is found guilty; this would impede any further political goals she might have. Is there any other use for these complaints?

    I’ve posted sometime since this chaos resignation that one of the first things Parnell needs to be apprised of upon his being sworn in, is the conduct & form of the Chief of Staff, whose mistrepresentation of the ethics complaint filing form which appears on the State of Alaska Governor’s website release page. If the Governor’s office cannot present truthful written releases for reading and review by the citizens and the country at large, but are written with the intent to intimidate, it is no wonder that citizen’s are as critical as they are — I know I would be as the wording to me places a wedge between the state and the citizens.

    The Chief of Staff in the ‘illegal’ word reference is attempting to silence the public. The link to Andrew’s site set out by Kath in comment #164 is the explanation of why people can announce and discuss the complaint, the onus for confidentiality is on the them.

    As for the comment they make about Ms. McLeod having applied for and not getting a job — it’s not the first time the Governor’s office has used that in one of the Releases on the Governor’s website. It too has been referred to in the articles which appear on ADN and other publications.

    The Chief of Staff has been employed by the State for a long time through many administrations. Length of time does not equate to professionalism.

    I know I could not resist one day, that I posted a comment regarding the Chief of Staff that “would you like some coffee with that snark” as reading articles wherein he has commented, he sounds angry, fed up with his job and in my opinion, he’s not an asset the State. There is also the question of whether he too has stepped over the line of ‘confidentiality’ with regard to the complaints filed.

    Bravo back at ya’. Well said. It is an understatement to say that history will not be kind to Palin — thanks to the many amazing people, many of whom risked (and actually suffered from and might still suffer) serious personal consequences, and doggedly and honestly exposed Palin for the self-serving grifter that she is and who ultimately humiliated her out of office in a very public, embarrassing way.

    Adding to Sarah “the perpetual victim” Palin’s public humiliation and embarrassment, she unsuccessfully and desperately tried to save face with a laundry-list of incoherent, nonsense arguments that no rational person could accept — such as: “I’m not a quitter, I’m a fighter.”

    On the other hand, history will most certainly be very kind to the many folks who ran sleazy Palin out of Dodge.

    I would not be surprised if all of this is not in a book and a college course in ethics? politics? or maybe American history?

    Palin v. the “pajama wearin,’ basement livin'” bloggers = democracy in action!

    Late to the game but how can you establish Ak gov actually “paralyzed.” Were state workers at work? getting paid? working for AK? DId any legislaitve activity come to a complete halt. Did the legislators continue to work for AK?

    One would think McSame’s staff had a legal thinker who would have said turn AK over to your LtG…

    Bear in mind, this compl. does appear to be vengeful given the number of filings by McLeod. She probably has lost credibility with these complaints. JMHO.

    Having said this, remember two things: Todd Palin was running AK (wink) and SP sounds so Bee-atchy in her “twit.” Silence speaks louder than words, she’ll never know.

    Bravo! I say job well-done to all the brave Alaskans, especially Andrea McLeod and Linda Biegel, who risked the wrath and revenge (and now – horrors – being publicly tweeted) from the imperious Palin to file these complaints.

    While I don’t believe for a minute they are the real reason she resigned, I don’t doubt for a second that they really do bother her a lot because they serve as a written record and constant reminder of what a really lousy governor she was. It is very well documented now that this is a governor who always, always, always put her personal ambition and greed before the job she solemnly swore to perform.

    She can ‘thump’ all she wants but the record is pretty clear. Sarah Palin used the State of Alaska and the citizens of Alaska to progress only one cause – Sarah Palin.

    There is no argument in this world that can convince me that Sarah Palin quitting her position the way she did, when she did, is going to serve her well in the future in any public discussion. It may get her richer quicker in the short-run, but in the long-run Sarah Palin will be remembered as the stunningly incompetent, unqualified, shallow, dishonest, scheming quitter that she really was and continues to be.

    In other words, Palin’s TwitterBerry statement is a quintessential example of a blatant violation of Sec. 39.52.140(b).

    Anyone surprised?

    I wonder what the penalty is for such a violation. Anybody know?

    At a minimum, such a blatant and indefensible violation of Sec. 39.52.140(b) by Palin justifies the filing of a “non-frivolous (that is, meritorious on both the facts and the law) ethics complaint against Palin.

    I hope Ms. McLeod is a mutflats reader and picks up on this.

    In my opinion, it is not simply the problem of an inherent psychological ability to hold on to power that kept her from transferring it while she was out of state, but consider the concrete problems (all of which very much support Andree’s petition). For example,

    If a Governor passes along her powers as Governor, would she not also pass out of her hands the ability to control information as her administration has managed to do?

    Is it remotely possible that McCain spokespeople would have been handling requests for information from the Alaskan government if someone had not maintained her “title” while on the campaign trail?

    And, more on the psychological side, if no one in Alaska were to have noticed the Gov’s absence as the state continued its business under its constitutionally-designated titular head, what might that have meant for her political future if her campaign lost?

    (7) compliance with a code of ethics is an individual responsibility; thus all who serve the state have a solemn responsibility to avoid improper conduct and prevent improper behavior by colleagues and subordinates.

    Sec. 39.52.120. Misuse of official position.
    (b) A public officer may not

    (6) use or authorize the use of state funds, facilities, equipment, services, or another government asset or resource for partisan political purposes; this paragraph does not prohibit use of the governor’s residence for meetings to discuss political strategy and does not prohibit use of
    state aircraft or the communications equipment in the governor’s residence so long as there is no charge to the state for the use; in this paragraph, “for partisan political purposes”
    (A) means having the intent to differentially benefit or harm a
    (i) candidate or potential candidate for elective office; or
    (ii) political party or group;

    Sec. 39.52.130. Improper gifts.

    (f) A public officer who knows or reasonably ought to know that a family member has received a gift because of the family member’s connection with the public office held by the public officer shall report the receipt of the gift by the family member to the public officer’s designated supervisor if the gift would have to be reported under this section if it had been received by the public officer or if receipt of the gift by a public officer would be prohibited under this section.

    Sec. 39.52.140. Improper use or disclosure of information.

    (b) A current or former public officer may not disclose or use, without appropriate authorization, information acquired in the course of official duties that is confidential by law.

    Sec. 39.52.190. Aiding a violation prohibited.
    It is a violation of this chapter for a public officer to knowingly aid another public officer in a violation of this chapter.

    I understood “thumped-up” immediately. A common expression here is “Bible thumping” or “Bible thumpers,” used to describe those who enthusiastically, and loudly, rap a Bible held in one hand with four fingertips of the other to reinforce a religious conviction. It’s like saying, “See here? Here? It’s in The Book! It is true!” The longer and louder one thumps, the more the true believers truly believe. Likely this term is in Palin’s vocabulary, and she uses it here to describe the relentless drumming of complainants and bloggers as they tap (thump) their keyboards of false witness to communicate with others of like mind, who pick up the beat and pass it on to persecute the pious 😉

    I loved Kerry’s response to Palin’s dopey op-ed in the Washington Post. I guess WaPo will do anything to get traffic to its website. As long as Palin sells newspapers (or generates web traffic) it looks like she’ll have a pulpit from which to preach her babbling brew of blather. I got wind of the OpEd piece and headed straight to WaPo. . . and then early Tues morning, one of the first things that came to my attention as I started my internet day was Kerry’s riposte on Huffington Post. No matter what Palin does, some people still love her.

    I listened to Ron Reagan Jr’s radio show today and heared Mim call in and bluntly declare that the reason she loves Sarah Palin is because Sarah Palin is so ‘honest’. Reagan and CC were polite to this caller but barely hid their bafflement. How could, um, anyone sincerely believe that Sarah Palin is honest? Reagan asked the caller to explain and she said something about Palin being open about her family problems. . . . Sarah Palin has never been open about her family life. There was no way she could have hid Bristol’s pregnancy but this calle seemed to think the reason the caller knew Palin had a pregnant teenager last summer was because Palin was honest. . . and this caller seemed completely oblivious to the endless, very open instances of Palin’s lies. . . . the caller doesn’t believe Palin lies even when lies are proven. . . and lots and lots of people fall for this. . . they like Palin’s spunky, cute sparkle, they think Palin is common like them and it seems to boost their self-image. . even though, as many have pointed out, Palin is not your typical joe-six-pack blue collar gal. . she is a college grad with a household income inexcess of $200,000 . . . she is far, far, far above ‘common’ people economically plus she wsa reared by college educated parents. . . . she apeals to underedeucated blue collar voterse, much like George W. did. . . . it is so scary, the Palin appeal.

    IF, and that is a giant if, the personnel board actually hired an impartial, competent attorney to investigate this complaint, $arah would have to hand over her blackberry, official and unofficial, emails to support any claim she was fulfilling her duties as Gov. It puts her in a bad position as well; to try and claim that she was able to campaign 24/7 for almost 10 weeks in the final race for the White House AND run the State of Alaska means that either she did her governorship poorly or running Alaska did not require much work on her part.     I’ve been reading and digesting all the information about Buttercup and the ethics compaints and then reading and re-reading all the tweets – it’s all very interesting to me. I’m thinking back when I freelanced for a crisis management firm and I’m seeing a classic strategy being used here. Number one rule with manageing a crisis is get to the press before the ‘bad guys’ (reporters and citizens-in-the-know) do, publicly acknowledge the crisis and get your spin on it before all sh!t hits the fan, then it’s dropping sound bites over and over again to support your claim.

    I think Buttercorrupt might be worried about a ‘crisis’ a-coming. I know most of us here feel there’s a much bigger iceberg out there but I see the beginning of a crisis management campaign. It’s been brewing for a while but really kicked in — or should I say, thumped-up — with the dazzeling, spewing on July 3rd and now the recent tweets and Van F*ck’s responses.

    Just had to share.

She seems like the type who would say, “Mrs. Palin? That sounds like my mother-n-law. Call me Sarah.” Which of course is why I would want to call her that.

If the church isn’t going to represent Christ and help those who are unjustly served, then who is? Bloggers are doing the Martha ministry (story of Martha and Mary), where Mary was sitting at Jesus feet listening, while Mary busy preparing and serving the meal (work). There are references to Mary and Martha ministries. The Mary’s learn, but the Martha’s are equally as important – they do the hands on work that no one else wants to take on.

    I think she has actually put this on the SOA website at one point! The “other site” is claiming Eddie burke said that Andree said she would stop filling complaints if she got a state job…As if…!     And yes, that would be confidential, only to be revealed to a response to a job reference, I believe Andree can sue the pants of her! 🙂

    Yes, the same attitude prevails about torture among some people. The difference is that WE can make the torture investigation happen. Slowly, inexorably, the pressure is building. In my opinion, that is what Obama wants. He needs it to come from the people, not from him, so it is politically workable.
    The Personnel Board in Alaska answers to no one but the Governor. Public pressure will only help with issues that the Legislature can address. So, for example, Troopergate could have been followed up if the public had exerted sufficient pressure.
    The frustration is both cases is equally real, though, isn’t it!

    I’m trying to remember what Senator W….ski (sorry, can’t remember his name) said on Shannyn’s show about the duties of the Lt Gov and the third in command. I probably have it all mixed up, but my understanding was that, as long as the Gov in on duty, the Lt Gov’s duties are very limited such as « guardian of the seal » or what not. He therefore could not take any initiative in case of a crisis in AK, such as Redoubt blowing up. Does anyone remeber what the good senator said ? Now again, I may have this all mixed up. He may have said that this is the case only if the Lt Gov is not confirmed by the Leg.

Nothing will change because she will have gotten away with it and SHE campaigned on doing away with that kind of stuff. She was just as guilty of it as Murkowski and everyone else.

    I speculate that the “personal ‘ATTACK'” the potential ‘stain’ on her miss goodness image is a very big issue for her.
    She may have run from the possibility of having to be found guilty, even if it only had a small monetary consequence.

    Except for paying back money improperly taken any possibly double that, theres a maximum $5000 fine attached to ethics violations.

    If she had pleaded guilty to every one, it would have cost her less to plead guilty than defend against them using van Flein.

    I think for her, her image trumps the dollars.

    I have been wondering when someone was finally going to bring this up. Every other Governor who has run for national office had turned power over to their Lieutenant Governors. But I guess that was BB, Before Blackberry. I also thought she should have turned over power to Parnell when she went to Kosavo to visit the National Guard soldiers. But again she did not. If there is not anything in state law, then it should be added that if the governor is going to be x miles or x hours away, temporary power should be given to the Lite Governor. What if Redoubt had gone off while she and the head of the National Guard were in Europe?

    I hope Alaska has a new standard for statewide office, because the nation cannot afford to give a national platform to another person who couldn’t even be mayor without hiring a full time administrator.

    Once her resignation is official, the ethics complaints will become moot and will not even be investigated. If the goal is to punish her and/or get back the wasted money, then these complaints should be filed as law suits. Otherwise, what is the point? The only good I can see coming from this is if the complaints are investigated (unlikely) and if she is found guilty; this would impede any further political goals she might have. Is there any other use for these complaints?

    I am glad to see this mostly in the sense that I never did understand why the LG was not put in charge.
    The weekend before was the Rural Energy Conference at Girdwood and Gino had been slated to speak. The LG showed in her place with no real explanation. It all made a lot more sense a few days later when the VP announcement was made.

    It does make it a bit easier to see how she could so easily make the decision to walk away from her job and her responsibilities roughly half way through her term of office. She had already made that decision once. Walked through that psychological door and closed it behind her.

    The politicians and lame ducks who so selfishly go on junkets and slide through the end or their terms, are actually a reference to herself and nobody else.

    So making that decision again was, for her, just her politics as usual.
