As if One Wasn’t Enough…..Meet Dan Sullivan.

Rep. Lindsay Holmes was the featured guest on today’s Demo Memo on KUDO 1080am.  Kathy Phillips asked what she thinks of the new AG nominee, Dan Sullivan.  Holmes has heard some concerns from members of the Alaska Bar.  Apparently there are some mumblings like “Couldn’t you find someone who’s actually living here?”  Kind of a “What are we, chopped liver?” vibe.

I’ll add to their griping by pointing out that there are now two Dan Sullivans in Alaska’s small pantheon; Dan Sullivan the incoming mayor, and now Dan Sullivan the Attorney General nominee.   I don’t know how everyone will deal with this yet.  Dan Sullivan the Mayor, Mayor Dan Sullivan, AG Dan Sullivan, Dan Sullivan the Attorney General…. We’re going to hear that a lot.  Personally, I’m waiting to see them side by side to come up with an appropriate deliniation.  I’m actually hoping to be able to use “Big Dan” and “Little Dan” but I don’t know their relative heights.  But if this is the guy, I have high hopes that Mayor Dan Sullivan will be known as “Little Dan,” and that just makes me smile.  But, I digress…

Holmes points out that Sullivan does own a house in Alaska, and lived here from 1998 until 2002.  He is still registered to vote here, and has clerked in both the Supreme Court, and the Ninth Circuit Court in Fairbanks.

Will the Legislature vote to confirm?  “Short of us finding something blatantly wrong with them we give the governor the deference of surrounding him or herself with the people they want,” said Holmes.

She goes on to say that it’s not the Legislature’s job to second guess whether the governor picked the best person for the position, but to figure out whether the person is qualified and will do a good job.

Confirmation hearings  for Sullivan won’t happen until at least January and the vote probably won’t happen until the end of next session, after he has been the acting AG for 8 or 9.  “If there are any red flags they would have shown themselves by that point.”

    in my opinion, as a general observation…AK doesn’t follow the rules like other states, so whatever sounds fishy to you or under the table or behind closed doors or the least bit corrupt, would be allowed to occur in AK….we know palin is behind this in some way or a big stink would be heard coming from that direction.

    The Native village of Point Hope took to the Federal Courts to rescind (take back, dump, shred) a whole lot of leases the Federal govt issued for a specific area. And the state of AK – aka the new, improved, spiffy AG who has hit the ground running – has “moved to intervene” within HOURS of said spiffy AG’s swearing in.

    (Sounds like he doesn’t even have the key to the washroom yet but…)

    Sez the AG: priority is to “safeguard & defend AK’s interests… in re to economic opps for AK … and the balance of state and federal rightsand responsibilities…

    IMO there is a very good reason that she suddenly has a Bushco Attorney-General. No “maybe” about that. ‘Some’ Republicans are clearly trying to legitimize her for a 2012 run.

    A very good indicator is that she didn’t have a fall-back position in the Ross rejection – i.e. she screwed it up by choosing a friend and supporter (again).

    Someone else has made the “right” choice for her.

    No, I don’t think it works that way. My niece is a dog groomer, working/living in Vancouver, Washington (no state income tax). She also did work across the river/border in Portland, Oregon (yes state income tax). Working parttime jobs. So any pay she received in Oregon was subject to Oregon state income tax. Doesn’t make or break the residency issue, she was still a WA resident.

    Also, as some have pointed out above, just like the military, college students, or people working temporarily out of state, they can legally vote absentee ballots because they are still residents. Don’t have to wait out the “residency” requirements to vote in the new state.

    BigSlick–No, he only received them through 2003 (for residency through 2002). We don’t have any state income tax in AK, so no help there. Given that he’s owned a house in AK since the late 1990s (I think), he’s undoubtedly been paying property tax on that. I think the write-up on him said that he’d been voting absentee in AK as late as 2008, but which I would guess they meant at least the Aug. Primary if not also the Nov. General.

    But I think an equally good question would be, has he paid State income tax in another State all this time? And another would be, which polling place did he report to for the November 4th 2008 election?

    GINO is hiring someone who will help her slime her way into Washington, and she may be helping him to get back to take a role in Alaska’s political future.

    8 to 9 months is a long time to wait for confirmation hearings on an AG who might is already looking to be a fire breathing Mega-Palinbot.

    @85 Kat: A significant number of Bush admin attorneys got their JDs at Liberty University. I have to think that a lot of potential employers / law firms (even conservative ones) would be a little twitchy about hiring them. When you are not the Executive Branch of the Federal government, you actually need your lawyers to understand the law.

    Dano (just my suggestion) at least has his JD from Harvard.

    I’d like to be positive about the new AG appointee, but I keep thinking back on the stories of Attorney’s in the Bush administration being unable to find new jobs because no one wanted to hire them because of their biases, ineptness, and general untrustworthy natures. Followers to the cause. Independant thinkers wouldn’t have been tolerated. Sounds like the description fits her high and mightyness’s requirements.

    Pepper1939–as soon as one is appointed he becomes AG (or acting AG maybe?) until confirmation. Because Session isn’t in at the moment, he’s got the job until he’s confirmed or not. I think he has to be sworn in, so as to commit to upholding the Constitution and all that. WAR was AG for all of what, 2 weeks? His name got on the letterhead too.

    Y’know, if someone were of a suspicious mind, they just might think that this is a case of GINO “looking out” for the Joe Blow citizens of Alaska. That could suggest that those who are not “Joe Blow” are little more than chopped liver (as in let ’em eat cake, get new leadership and move out of the villages type chopped liver). But that’s only if one is a suspicious type.

    Also too, one might wonder about that “balance of state and federal whatsit – rights and responsibilites” What balance is the “appropriate” one, and according to whose standards.

    Is the AG aware of SP’s concept of “states’ rights”? will he share them? Will he be a by-the-book kind of atty or will he instead, look to the book to find the loopholes?

    Sounds like the Native village wants to protect itself, while the state wants to protect “Alaskans” (what are Natives, then?) as well as “balance” the state & Federal rights.

    I wonder if he and SP are on the same page regarding “States’ Rights.”

    It makes me nervous. It’s so meticulously innocuous it’s unnerving. It’s – Hm. Gonna think about this a bit.

    We cannot expect Palin to nominate a Progressive and/or Democrat AG any more than “they” can expect Obama to appoint a neocon/Republican for SCOTUS. This Sullivan is highly-educated with good creds. I am hopeful that he will be above being hypnotized by GINO’s winking and pagaent walking.
    I am witholding judgement here. The GINO spends a good amount of Alaska’s funds suing the Federal Gov. with regard to ecological or spiecies protection -she loves to sue the Feds! Sullivan will be expected to assist with this (I presume); It will be intersting to see how this plays out. If he is rational and plays well with others, it could ok – what a contast to WAR!

    One of the most anti-social, freakish guys I ever met is in Oregon, a Greek professor at a local liberal college. You never know. His wife is awesome, their kids are major nutcases. The nine year old throws tantrums like a two year old and wets herself in public. The 5 year old boy does the same with a mad face and a scream that gets under your skin you wanna run as far away as possible. Their two year old is developing into a little monster also too.

    I believe that the where-you-vote issue is a matter of state law. I know that many states make special provisions for some or all of: legislators, legislative staff, appointed administration members. The reasoning is that if you take a “political” Federal job, you’re going to live in DC a lot of the time, because that’s where the job is. However, since such jobs are, theoretically “temporary public service”, if you’re willing to maintain a residence back home, you can choose where you want to vote.

    This is similar to the treatment extended to active duty military — generally, you can keep the driver license, voter registration, and tax status of the state where you were resident when you activate (even without maintaining a house/apt).

    Realistically, we cannot expect an AG appointment from Sarah that doesn’t have “conservative” credentials.

    Past experience has taught us that any Palin appointment is suspect.

    All I’ll venture at the moment is that based on his bio (which I’m sure he (or someone close to him) wrote, Daniel S. Sullivan appears to have far better legal chops than W.A.R., whose legal acumen was mediocre at best.

    The 2003 PFD is for residency in Alaska DURING 2002. If he lived in AK through 2002 but then moved to D.C. in 2003, he WAS qualified to receive the $ for 2002. He would have had to have it mailed to where he lived however. Given that he didn’t receive them after 2003 makes it clear that he was not PRESENT in AK for the qualifying amount of time in those subsequent years. Really, people, this is NOT that big a deal…

    Based on what I’ve read about Sullivan, he wouldn’t even qualifiy for in state tuition at a U of Alaska campus (see below for requirements) so how can he be our AG?

    To receive in state tuition, the follwoing must be met:

    Any person, or Dependent Child of an Alaskan resident, who has been physically present in Alaska for one year at the time of class registration (excepting documented absence due to illness, vacation or attendance at another educational institution while maintaining Alaska residency, or other absence for periods not exceeding an aggregate of 120 days) and declares an intention to remain in Alaska indefinitely is classified as a resident for tuition purposes.

    Documentation of continuous residency in Alaska for the previous year must be available.

    Isabella–I know people who lived out of state for 3 years, didn’t get their PFDs for that time but still voted absentee here (kept house here, were going to retire back to here after D.C.), and are in the middle of the requalifying year for PFDs. That was what I meant.

    pvazwindy–the 2003 PFD arriving at a D.C. address would have been for being an AK resident through 2002 but having moved since the qualifying year. On that basis, I don’t see an issue. Not that I don’t think an actual AKan lawyer shouldn’t have been picked…

    Does this help? The Alaska Bar Association registry lists Sullivan with an address in Bethesda, Maryland, but he said he’s now moved back into his home in Anchorage. Records show he received permanent fund dividends at Alaska addresses from 1999 through 2002, and then in 2003 with a Washington, D.C., address.

    He voted absentee in Alaska elections as recently as 2008.

    When we were in Oregon, I met a couple dozen who are faking their addresses in AK to get dividend but living fully out of state. There should be more fraud investigations and a longer waiting period then 1 year to apply.

    My daughter, a 20 year Alaska resident, moved to Seattle after college to see if she could make it in the city. She’s had 2 PT jobs there but stll votes absentee here and ya know what – she was just notified that she is denied a PFD for 2008. So I don’t care how many houses this Sullivan guy owns up here, where he votes, who he clerked with, where his wife was raised … if he’s not been getting a PFD these past so many years, he ain’t a resident. End of story!

    I am confused. If he hasn’t lived in Alaska since 2002, why is still registered to vote in Alaska. Would it be legal for him to vote in Alaska without a current Alaskan residence? This doesn’t sound like a good introduction for the appointee. I thought Palin and her crowd were all about the importance of being a real Alaskan. Seems odd that she would pick someone who has lived a very small percentage of his life in Alaska and choose to leave it 7 years ago.

    As I wrote before, this guy has obviously been chosen for his readiness and willingness to bring several anti-environment lawsuits against the federal government (which is why McBill has been assigned the A-G’s personal liar).

    But if Madame thought his confirmation hearings could be held at any time she may have been a bit more judicious (ha! as if) in her choice. Certainly this dude is a step up from Ross (which is no compliment).
